HomeMy WebLinkAboutCC RESO 11,587RESOLUTION NO. 11,587 RESOLUTION DEFERRING REQUIREMENTS FOR INSTALLATION OF CURB, GUTTER AND SIDEWALK AT 2231 EAST 32ND STREET (Carl Walkup) BE IT RESOLVED by the City Council of the City of National City that the application of Carl R. and Retha M. Walkup for deferral of the installation of curb, gutter and sidewalk at 2231 East 32nd Street is granted subject to the following condition: 1. The filing with the Planning Department of the City of National City a covenant running with the land, providing: a. The property owner will not protest the installation of any of the required improvements under a 1911 Improvement Act program whether initiated by the property owners or the City; and b. The property owners will install said improvements in conjunction with an overall improvement program of the area whether initiated by the property owners or the City. Walkup is the owner of that certain real property located in the City of National City, County of San Diego, State of California, described as follows: . The Southerly 125 feet of Lot 12, together with the Westerly 10 feet of the Southerly 125 feet of Lot 13, Orange Villa National City, Map Number 1333 filed in the office of the County Recorder of San Diego County, California, May 11, 1911. WHEREAS, said owner desires to be excused from the legal requirement to install curb, gutter, sidewalk and permanent paving for one-half the street width, on 2237. East 32nd Street NOW, THEREFORE, in consideration for the granting of a deferral to install said improvements by the City Council of the City of National City, said owner covenants forthemselvesand ___their heirs, successors ^:signs, ex- ecutors and administrators as follows: 1. The property owner will not protest the installation of any of the required improvements under a 1911 Improvement Act program whether initiated by the property owners or the City. 2. The property owner will install said improvements in conjunction with an overall improvement program of the area whether initiated by the property owners or the City. 3. Property owner will install improvements waived upon demand of City, within 30 days of demand, or City will be entitled to install said improvements and charge the owner of the burdened property therefor, and upon failure to pay said charge the City may maintain an -action at law against the owner therefor. Said Covenant shall be run with and be a burden on the within described real property. DATED.
