HomeMy WebLinkAboutCC RESO 11,605RESOLUTION NO. 11,605 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING A BLANKET DEFERRAL FROM THE IMPROVEMENT REQUIREMENTS OF ORDINANCE NO. 1256, IN ALL CASES WHERE IT IS DETERMINED THAT STREET PAVING, CURB, GUTTER OR SIDEWALK WAS DAMAGED OR BROKEN BY STREET TREES The City Council of the City of National City does resolve as follows: WHEREAS, City Ordinance No. 1256 requires that in all zones within the City of National City, prior to occupancy or final inspection by the Building Inspector for the construction, alteration, repair, enlargement, conversion or relocation of all structures or buildings in excess of $2,500 valuation, any damaged or broken curb, gutter or sidewalks shall be replaced; and, WHEREAS, said Ordinance further provides that in all zones within the City of National City, prior to occupancy or final inspection by the Building Inspector for the construction, alteration, repair, enlargement, conversion or relocation of all structures or buildings in excess of $16,000 valuation, any damaged or broken permanent paving shall be replaced for one-half the street widths on public streets adjacent and accessible to said property; and, WHEREAS, the City Council did, on March 26, 1974, establish a policy whereby all damage to curbs, gutters, sidewalks or street paving caused by street trees and which causes a dangerous condition, shall be repaired by City forces; NOW, THEREFORE, BE IT RESOLVED THAT the City Council hereby approves a blanket deferral from the improvement requirements of Ordinance No. 1256, in all cases where it is determined by the City Engineer that existing street paving, curb, gutter or sidewalk was damaged or broken by street trees. This deferral will not be in effect, as to respective properties, until a "Covenant running with the land not to protest installation of improvements under a 1911 Act whether initiated by the property owners or the City" has been duly filed.
