RESOLUTION APPROVING EXECUTION OF AGREEMENT BETWEEN
THE CITY OF NATIONAL CITY AND HERBERT & DAVID
WILLIAMS FOR CUL DE SAC OF 30TH STREET AT WILSON AVENUE
BE IT RESOLVED by the City Council of the City
of National City that the Mayor of National City is hereby
authorized and directed to execute, and the City Clerk is
authorized to attest, that certain Agreement between the
City of National City and Herbert and David Williams for
Cul de sac of 30th Street at Wilson Avenue.
PASSED AND ADOPTED this 12th day of March, 1974.

AGREEMENT
This Agreement made this i 'day of /M /T' , 1974
by and between the City of National ty,herein cal ed "City", and Herbert
Williams and David Williams as Trustees under the Williams Family Trust, herein
called "Williams".
WITNESSETH:
WHEREAS, the City is the owner of that certain real property more
particularly described on the attached Exhibit "A". Said parcel referred to
herein as Parcel "A" containing approximately 13,342 square feet; and
WHEREAS, the City proposes to terminate 30th Street at its intersection
with Wilson Avenue by installing a cul-de-sac at the terminus of said 30th Street
at no cost to adjoining property owners; and
WHEREAS, Williams is the.owner of that certain parcel of real property
more particularly described on the attached Exhibit "B". Said parcel referred
to herein as Parcel "B" and containing approximately 2, L5 ,quare feet; and
WHEREAS, it is necessary that if the City is to construct the
proposed cul-de-sac, the City must acquire Parcel "B" for street purposes.
NOW, THEREFORE, the parties do hereby agree as follows:
SECTION 1. 0n or before March 15, 1974 Williams agree:, to convey
Parcel "B" by Grant Deed to the City of National City for street purposes.
SECTION 2. As consideration for the •conveyance provided under Section 1
hereof the City agrees to vacate and close to public use all that property herein
identified as Parcel "A". Upon closure and vacation the City agrees to convey
said Parcel "A" to Williams by Quitclaim Deed, reserving therefrom certain
easements set forth in the deed of conveyance. Said closure, vacation and
conveyance accomplished pursuant to this section shall be accomplished on or
before a Notice of Completion is filed by the Redevelopment Agency of the City of
National City for Site Preparation and Demolition Contract No. 5
SECTION 3. Upon conveyance of Parcel "A" pursuant to Section 2 hereof
and no later than ninety (90) days after the date of conveyance Williams agrees to
landscape and maintain the westerly ten (10) feet of Parcel "A" in such a manner -
as to beautify and attractively screen the property as viewed from Interstate 5
Freeway. Said landscaping shall contain trees and shrubs of a common variety
planted in such a manner as to effectuate the screening and beautification.
Landscaping shall be approved by the City prior to installation. The landscaping
shall be served by a permanent underground irrigation system sufficient to maintain
all vegetation planted. The property owner and/or successors in interest shall be
responsible for. all maintenance, including periodic watering and upkeep of the
landscaped area.
SECTION 4. If notified in writing no later than March 15, 1974, the
City will agree to install a sewer service lateral up to the northerly limits
of the twenty (20) foot railroad right-of-way adjoining said Williams property on
the north. If a sewer lateral is requested pursuant to this section, Williams
agrees to pay the City the standard City fee estimated to be $2,772.00 for the
installation thereof. The cost of any subsequent connection to said sewer
lateral shall be borne by Williams or successors in interest. Notice given the
City pursuant to this section shall be directed to the Redevelopment Agency of
the City of National City, 1243 National Avenue, National City, California 92050.
SECTION 5. This Agreement shall be binding upon and inure to the
benefit of the heirs, assigns, executors, personal representatives and
successors in interest of the parties hereto.
SECTION 6. This Agreement shall be subject to approval by the
City Council of the City of National City.

along the Westerly line of said Map No. 1815 South 17°43'34" East, Record
South 18°35' East, 106.67 feet to a point in the arc of a 382.24 foot radius
curve concave Northerly in the Northwesterly prolongation of the centerline
of the 20 foot easement for railway purposes as described in Deed to San
