RESOLUTION AUTHORIZING EXECUTION OF
CONTRACT FOR STREET LIGHTS IN E. J. CHRISTMAN
BUSINESS & INDUSTRIAL PARKI
BE IT RESOLVED that the Mayor is authorized and
directed to execute that certain "Special Contract Street
Lights E. J. Christman Industrial Park" dated the 24th day
of December, 1973, between the City of National City, the
Redevelopment Agency of the City of National City, and San
Diego Gas & Electric Company, which contract provides for
the installation and the maintenance of a street lights
system within the E. J. Christman Business and Industrial
Park, Unit No. 1.
PASSED AND ADOPTED this 8th day of January, 1974.

ELECTRIC COMPANY, a corporation (Utility), and the CITY OF NATIONAL
CITY (City), and THE REDEVELOPMENT AGENCY OF THE: CITY OF
NATIONAL CITY (Redevelopment Agency).
In consideration of the mutual obligations of the parties herein, the
parties agree as follows:
1. Utility agrees:
(a) To install an ornamental street lighting syste*r con-
sisting of Utility's standard concrete aggregate pole
with six-foot bracket supporting a conventional street
lighting luminaire, and cable and substructures re-
quired to serve the street lighting system, all as more
fully described in Exhibits A and B attached hereto and
incorporated herein. Title and ownership of said equip-
ment shall, at all times, remain with Utility.
(b) To furnish electric energy, switching service, and main-
tenance for the street lighting system described in (a)
above.
2. Redevelopment Agency agrees:
(a) To furnish a trench and backfill, in accordance with
Utility's specifications required for the installation
of the street light system as described in Exhibit A.
(b) To pay to Utility the non-refundable sum of $37,513
as a contribution toward the installation of said facili-
ties within the boundary of the E. J. Christman Indus-
trial Park, as described in Exhibit A.
3. City agrees:
(a) To furnish a trench and backfill, in accordance with
Utility's specifications, required for the installation
of the street light system as described in Exhibit B.
(b) To pay to the Utility the non-refundable sum of $3,335
as a contribution toward the installation of the facili-
ties described in Exhibit B.
(c) To pay monthly the charges for the entire street light
system comprised of 49 lamps as described in Exhi-
bits A and B, at a rate per lamp of $ e.53 per
month, plus the applicable fuel cost adjustment amount,
for a period of three years, commencing
. Nay 1 , 19 74 , or as soon thereafter as

Utility is reasonably able to supply said service.
(d) Or, in the event that the California Public Utilities
Commission adopts the revisions to the Uniform Sys-
tem of Accounts set forth in Federal Power Commis-
sion Order No. 490 to pay monthly the charges for the
entire street light system comprised of

lamps, as described in Exhibits A and B, at a rate per
lamp of $ 6.60 per month, plus the applicable
fuel cost adjustment amount, for a period of three years,
commencing Nay 1 , 19 74 , or
as soon thereafter as Utility is reasonably able to supply
said service. --
4. The parties agree that upon the expiration of the original term,
this Contract shall be automatically extended for successive terms of one
year each; provided that this Contract may be terminated by either party upon
not less than sixty (60) days written notice prior to the expiration date of the
original term or any extended term.
5. The parties agree that no change shall be made in the above
street lighting system, except by modifications mutually agreed upon in writ-
ing. At City's request, new street lights may be added at the then applicable
rate in Utility's filed tariff schedule; provided that no change will be made in

the location of existing lights installed under the provisions of this Con-
tract unless the expense thereof' is paid by City.
6. City agrees that should service to any of the above des-
cribed street lights be discontinued during the first year of service follow-
ing installation, it shall pay to Utility the net installation and removal
costs incurred by Utility to render such service. City further agrees that
should said service be discontinued during the second or third year, it
shall pay to Utility said netcosts, less one -twenty fourth (1 / 24th) of the
total amount for each month that service is continued beyond the first year.
7. Utility agrees to use reasonable diligence in providing unin-
terrupted service, but does not guarantee continuity or sufficiency of

or if for any reason Utility is unable to supply energy for said lighting ser-
vice, City agrees that the only liability of Utility shall be to rebate the pro-
portionate charge for the time that such lamps fail to burn, excluding the
time preceding notification to the Company of the particular outage and the
first twenty-four (24) hour period thereafter.
8. City and Redevelopment Agency agree to be governed by the
Utility's applicable Rules on file with the California Public Utilities Commis-
sion, which Rules are made a part hereof by reference, and a copy of which
will be furnished to City and Redevelopment Agency upon request. This Con-

tract shall, at all times, be subject to such changes or modifications as
said Commission may, from time to time, direct in the exercise of its
jurisdiction.
IN WITNESS WHEREOF, the parties hereto have caused this Con-
tract to be executed for and on behalf of each, by their duly authorized
agents, partners, or corporate officers, as of the day and year first above
written.
