HomeMy WebLinkAboutCC RESO 11,291RESOLUTION NO. 11,291 RESOLUTION AUTHORIZING EXECUTION OF CONTRACT. FOR REAL ESTATE APPRAISAL BETWEEN LEE C. JOHNSON COMPANY AND THE CITY OF NATIONAL CITY BE IT RESOLVED that the City Manager is authorized and directed to enter into a contract for real estate appraisal between Lee C. Johnson Company and the City of National City. PASSED AND ADOPTED this 22nd of January, 1974. ATTEST: CITY CLERK Contract for Real Estate Appraisal THIS AGREEMENT entered into this 22nd day of January , 1974 , by the City of National City, a Political Subdivision of the State of California, hereinafter referred to as the CITY, and Lee C. Johnson Company, 8321 Lemon Avenue, La Mesa, California 92041, County of San Diego, State of California, hereinafter referred to as the APPRAISER, WITNESSETH: The parties hereto do mutually agree as follows: 1. The Appraiser shall, within 90 calendar days after the date of execution hereof, furnish the City, an original and two copies of a written appraisal report (hereinafter referred to as the Report) of the fair market value of the real property, located on the south side of West Plaza Boulevard, National City, California, and identified as Tax Assessors Parcel No. 587-380-42 and 46. In addition the Appraiser will value adjoining parcels as owned by the City. At the minimum, Report will conform to County of San Diego Guideline For Narrative Appraisal Reports filed September 10, 1971, with the Clerk of the Board of Supervisors as Document No. 445451. 2. In consideration of the above performance, the Appraiser shall be paid the lump sum of $1, 500 which shall constitute full payment for the work done and reimbursement to the Appraiser of any expense incurred, including the cost of all supplies, material and equipment. Payment shall become due upon completion and delivery of a Report which fully meets the conditions of this A greement. -1- LEE C. JOHNSON, COMPANY 3. The Appraiser and the City understand and agree that this Report is being prepared for the prupose of providing the City with a professional valuation opinion to serve as a basis for negotiation and possible litigation and all parts thereof are to be treated as confidential. The Appraiser shall take all necessary steps to insure that no member of his staff or organization divulges any information concerning the Report. 4. The Appraiser agrees that upon request of the City, he will testify as to the value of any and all of the property included in the Report as of the date of valuation set forth in the report in any judicial or arbitration proceeding involving a determination of the value of said property. It is understood and agreed that in the event the Appraiser is called upon to testify, the Appraiser will be paid the additional sum of $1, 000. The above sum shall include payment for pre-trial conferences and testimony and for the preparation of the following exhibits: A. A map showing the subject Property in the before and after condition. B. A map showing the location of comparable' sales relative to the Property. C. As many pictures as are necessary to show the condition of the Property. D. An aerial photograph of the area. 5. Time is of the essence of this contract and if the Appraiser refuses or fails to perform this Agreement within the time specified, or any extension thereof granted by the City, the City may, by written notice, terminate the right of the Appraiser to proceed with the performance of the Agreement or with such part or parts thereof as to which there has been delay. LEE C. JOHNSON, COMPANY a 6. The Appraiser will stop work on the Report upon receipt of written notice from the City. In such event payment shall be prorated on the ratio which the completed work bears to the total work required to complete the Report. The Appraiser will submit billing, for approval, detailing work completed and time charges together with the uncompleted work product. 7. The City or its designated representative, shall have the right to inspect and audit all records, accounts, and other data maintained by the Appraiser which relate to performance or billing under this Agreement. 8. The Appraiser agrees that the owner or his designated representative shall be given an opportunity, by reasonable advance notice in writing or otherwise, to accompany the Appraiser during his inspection of the property. Appraiser will be required to furnish, upon request by the City, evidence of compliance with this paragraph. 9. The parties hereto have herein set forth the whole of their Agreement.
