RESOLUTION APPROVING TENTATIVE SUBDIVISION .MAP
AND GRANTING A PLANNED RESIDENTIAL UNIT DEVELOPMENT
PERMIT PURSUANT TO ORDINANCE 1077
(No. 58 - John C. Noble Company, "Regency Acre",
702 "R" Avenue)
The City Council of the City of National City,
California, does hereby find, determine, order and resolve
as follows:
1. At a regular meeting of the City Planning
Commission on July 16, 1973, said Commission unanimously
adopted a recommendation that the tentative map for the
proposed "Regency Acre" subdivision be approved and that
the owner of the real property known as "Regency Acre",
702 "R" Avenue and more .fully described in Exhibit "A"
attached hereto and made a part hereof as though set forth
in full, be granted a Planned Residential Unit Development
Permit upon the conditions hereinafter stated.
2. That the City Council has received the
recommendation of the Planning Commission, and after full
and complete consideration of said recommendation hereby
approves the tentative map for the proposed "Regency Acre"
subdivision and grants a Planned Residential Unit Development
Permit to construct "Regency Acre" (condominium) subject to
the following terms and conditions:
a. That prior to approval of the Final Map the
following documents specified in the California Civil Code
shallhave been filed withand approved by the National City
Planning Department.
1. Diagrammatic Floor Plans
2. Consent to Record
b. That prior to approval of the Final Map the
applicant shall provide a declaration of Covenants, Conditions
and Restrictions, and responsibilities, including maintenance,
payment of taxes, etc., involved in said common ownership.
Said covenants, conditions and restrictions shall be subject
to approval as to content and form by the City. Attorney and
the City Council, upon recommendation of the Planning Commission.
c. Prior to City Council adoption of Resolution
Granting a Residential Planned Unit Development Permit the
property owner or his authorized agent shall first file with
the Planning Department an acknowledgment in writing stating
that he is aware of, and accepts, all of the conditions of
approval as hereinbelow set forth. (Acceptance form available
from Planning Department.)
d. Prior to the issuance of a building permit by
the Department of Building and Housing, City of National
City. for any portion of the development authorized by the
issue of this permit, the property owner shall first file
and record a subdivision map in accordance with existing city law
and Subdivision Map. Act of the State of California.
e. That all the landscaping shown on the approved
landscape plan, a copy of which is on file in the office of
the Planning Department of the City of National City, shall
be maintained in a vigorous growing and healthy condition.
f. That any change in the landscape plan which
reduces landscape areas, removes approved landscaping materials,
or replaces an approved plant type with another will first
require approval by the National City City Council. Additional
landscaping to that shown on the approved landscape plan may
be installed without prior approval.
g.. That an agreement be reached with the National
City Fire Chief to provide for fire apparatus turn -around,
access driveway, or on -site fire hydrant at rear of the project
site.
h. Construction shall commence within one calendar
year from the date of the resolution adopted by City Council
granting a Residential Planned Unit Development Permit. If
construction is not begun within said time, this permit and
the approvals granted thereby will be null and void and of no
further effect.
i. All off-street parking areas and driveways
incidental thereto, except required driveway approaches on
public property, shall be surfaced with minimum four inch
(4") thick Portland cement concrete or paved with minimum
three inch (3") thick asphalt surfacing or minimum two inch
(2") thick asphalt surfacing over a four inch (4") base of com-
pacted material approved by the City Engineer. All such paving
shall thereafter be properly maintained.
j. Property line separation wall shall have a
fire resistant rating of two hours -
1. No through penetration of separation wall
shall be allowed.
2. Separation wall shall extend continuously
from foundation to roof sheathing.
3. Protect ends of two-hour walls, one hour
equal to any depth of any projecting elements.
k. Outdoor security lighting fro walks, steps,
parking areas, driveways, and other facilities shall be
provided. Fixtures used to provide such lighting shall be
in keeping with the type of development and at locations to
assure safe and convenient nighttime use.
1. Site development shall be in accordance with
the plans on file in the Planning Department and all appli-
cable provisions of City Ordinance 1306.
m. Design of the building shall be revised to meet
the 2:1 parking required by Ordinance No. 1116.
n. Noncompliance with conditions of this agreement
shall constitute a violation of the Zoning Ordinance of the
City of National City.
Furthermore that the City Council waive the following
ordinance requirement of Ordinance No. 1116, pursuant to Section
2-P-1 of said ordinance:
Section 2-P-5, "Size and ownership of Planned
Residential Unit Development. A Planned Residential Unit De-
velopment shall consist of not less than two acres designated
for future buildings. The area must be either in one owner-
ship or the subject of an application filed jointly by the
owners of all the property included."
