HomeMy WebLinkAboutCC RESO 11,176RESOLUTION NO. 11,176 RESOLUTION AUTHORIZING EXECUTION OF OFFER TO PURCHASE REAL PROPERTY FOR "Q" AVENUE RIGHT-OF-WAY (State of California, Excess Parcels 16766-01-01 (16826, 16828) BE IT RESOLVED by the City Council of the City of National City that the Mayor is authorized to execute that certain Proposal to Purchase Real Property between the City of National City and the Department of Transporta- tion, State of California, said property to be used for "Q" Avenue right-of-way as well as for water and sewer easements. BE IT FURTHER RESOLVED that the City Finance Officer is hereby authorized and directed to issue a warrant in the amount of $4,250.00 from general fund monies and assign it to our Special Street fund to cover the cost of this transaction for said public purposes. This parcel is identified on your right of way map as Parcel No. R/W 16766-01-01 . I hereby bid the sum of FOUR THOUSAND TWO HUNDRED FIFTY - - -dollars ($ 4,250.00 ) as full payment for the purchase price of said excess parcel, and enclose a cashier's check or certified check for this amount payable to the order of the Depart- ment of Transportation. I further agree to deposit a check with the Depart- 'ent of Transportation for payment of recording fees and Documentary Stamp 'ax upon notification by said Department that the Director's Deed is ready or recording. . understand that this sale must be approved by the California Highway Com- mission. Upon acceptance by the Department of Transportation of the amount bid, and the approval of the proposed sale by the California Highway Commis- sion, the State of California shall issue a Director's Deed to the bidder or - his assignee conveying the right, title and interest of the State of Cali- fornia in said real property. No assignment of the bidder's interest may be made after the execution of this contract and prior to receipt of a Director's Deed, and any such attempted or purported assignment shall be null and void as against the State of California, Department of Transportation. I understand that I acquire no right, title or interest in said real property until the sale has been approved in the manner provided by law and a Direc- tor's Deed has been executed, recorded and delivered. Said Director's Deed will be processed in an expeditious manner by the Department of Transportation. I understand that the right, title and interest in the property to be trans- ferred by this sale shall not exceed that vested in the State of California, and that no policy of title insurance will be furnished by the State in con- nection with this transaction. The fee title to the parcel of land is vested in the State of California free and clear of all encumbrances, except special assessments, if any, restrictions, reservations and easements of record. The property shall be conveyed by said Director's Deed to CITY OF NATIONAL CITY (Show how title is to be vested) I understand that the Departmentrof Transportation shall record said Direc- tor's Deed, and that I may take possession of said real property as soon as said Director's Deed has been filed for record by the State. Said State of California reserves the right to reject any or all bids and to cancel the sale at any time prior to recording of Deed.
