RESOLUTION GRANTING A LIMITED COMMERCIAL PLANNED
DEVELOPMENT PERMIT PURSUANT TO ORDINANCE NO. 1077
(No. 59 - U-Totem Market, 1538 Harbison Avenue)
The City Council of the City of National City,
California does hereby find, determine, order and resolve
as follows:
1. At a regular meeting of the City Planning
Commission on September 24, 1973, said Commission unanimously
adopted a recommendation that the owners of the real property
more fully described below, be granted a Limited Commercial
Planned Development Permit upon the conditions hereinafter
stated:
Lots 1. and 2, Rancho Hills Unit No. 2,
Map 2389, as recorded in County Recorder's
Office of San Diego County Recorder, California.
2. That the City Council has received the.recommen-
dation of the Planning Commission, and after full and complete
consideration of said recommendation hereby grants a Limited
Commercial Planned Development Permit upon the following terms
and conditions:
a. Prior to the issuance of a building permit
for .this site, .the applicants shall file with the Planning
Department a covenant running with the land agreeing to hold
as one parcel, lots 1 and 2 of Rancho Hills Unit #2.
b. Prior to site plan approval, submit a profile
of the driveway intersection with 16th Street showing a differ-
ence in elevation of not to exceed .16 feet between a point at
the inside edge of the sidewalk and a point 16 feet inside of
said point (on site), and showing a transition section to the
approximate 10% exit/entrance ramp grade.
c. Site drainage shall be maintained at a mini-
mum of 1%..
d. Parking stalls may be sloped to a maximum
grade of 3%.
e. Yard and security lighting shall be shaded
from neighboring property and not directed on public property.
f. That no City Council action betaken to ap-
prove this permit until after site plan approval is made
(pending receipt of driveway profile required in Condition b
above) and until after clearance by the Environmental Impact
Committee. Additional conditions may be recommended based
on mitigation measures which may be recommended based on miti-
gation measures which may be specified by the EIC.
g. That the Planning Commission approve the
following as an alternate to the6'0" high masonry wall, above
the masonry retaining wall proposed for the westerly and north-
erly property lines:
A five foot wide landscaped strip containing landscaped
screening of approximately six feet (6.') in height pro-
tected by a curb from the paved area of the site. Said
landscaped strip to be improved in accordance with
landscape and irrigation plan for said area to be sub-
mitted and approved prior to the Department of Building
and Housing issuing a certificate of occupancy.
The choice of alternatives to be made by the applicants with
the written approval of abutting property owners.
h. Landscaping shall be installed and maintained
in accordance with the Landscape Plan except as follows:
(1) No ivy or climbing ground cover shall be used in landscape
strips along Harbison Avenue and l6th Street.
(2) Pyrus Kawakami to be 15 gallon size.
(3) Abelia Grandiflora to be 1 gallon size.
(4) Handina Domestica to be 5 gallon size.
(5) Raphiolepis Indica to be 1 gallon size.
i. All landscaped areas shall be protected by
a curb along the paved area of the site.
3. If at any time it is determined by the City
Council of the City of National City that the conditions above
set forth have not been satisfied, the City Council may declare
this Limited Commercial Planned Development Permit void and of
no further effect, without further proceedings or notice.
