HomeMy WebLinkAboutCC RESO 11,212RESOLUTION NO. 11,212 RESOLUTION GRANTING ZONE. VARIANCE PURSUANT TO ORDINANCE. NO. 962 (Z-7-73, 1420 Sheryl Lane, Fred Scott) The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That practical difficulties, unnecessary hard- ship, and a result inconsistent with the general purpose and intent of Ordinance No. 962 would occur through strict appli- cation of the provisions of said Ordinance to that certain real property hereinafter described. 2. That a Petition requesting a blanket variance has been filed pursuant to the provisions of Section 12 of Ordinance No. 962 and said Petition complies with all the requirements of said section. 3. That the National City Planning Commission did hold a hearing on said Petition and did recommend to the City Council that a variance be granted. 4. That the granting of a variance with reference to the property hereinafter described will not defeat, but rather will carry out the general intent and purpose of the National City Zoning Ordinance, will provide for the public safety and welfare and will administer substantial justice. 5. That a variance from the provisions of said Ordinance No. 962 be and hereby is granted with reference to all the certain real property situated in the City of National City, California, more particularly described as follows: All that portion of 80 Acre Lot 2 in Quarter Section 129 of Rancho De La Nacion, in the City of National City, County of San Diego, State of California, according to map thereof No. 166, filed in the Recorder's office of said county, described as follows: Commencing at the southwesterly corner of said Quarter Section 129; thence N 71°57'33" E, along the south line of said Lot 2, 662.18 feet; thence N 17°46'05" W, 478.96 feet to the true point of beginning; thence N 71°58'41" E, 173.74 feet; thence N 54°43'03" W, 80.32.feet; thence S 69°58'07" W, 125.55 feet; thence S 17°46'05" E, 60 feet to the true point of beginning. 6. That the variance hereby granted is as follows: Reduce the required four foot (4') side yard setback to two feet seven inches (2'7"); and, rear yard setback from the required five feet (5') to three feet six inches (3'6") to permit existing retaining walls, encroaching within required yards, to remain at 1420 Sheryl Lane, with the provision that the variance be granted provided that approved as to design by the Planning an adequate fence, Department, is con- structed from a safety standpoint on the southerly side of the property.
