HomeMy WebLinkAboutCC RESO 11,217RESOLUTION NO. 11,217 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR THE PERFORMANCE OF CIVIL ENGINEERING SERVICES BY RICK ENGINEERING COMPANY BE IT RESOLVED that the Mayor is authorized to execute, and the City Clerk to attest to that certain agreement for the Performance of Civil Engineering Services by Rick Engineering Company. PASSED AND ADOPTED this 14th day of November, 1973. ATTEST: AGREEMENT FOR THE PERFORMANCE OF CIVIL ENGINEERING SERVICES BETWEEN REDEVELOPMENT AGENCY OF THE CITY OF NATIONAL CITY AND RICK ENGINEERING COMPANY WHEREAS, the City of National City (City) acting through its Redevelopment Agency of the City of National City (Agency) desires to study the feasibility of developing certain real prop- erty situated in the City of National City, now known as the Bonita Golf Course, located generally in the southeast quadrant of Inter- state 805 and Sweetwater Road, said property now owned by the Koenig Corporation, for use as a regional shopping center, said center to be known as the Bonita Plaza (the Project); and WHEREAS, City and Agency have designated said real property as a "survey area" pursuant to the provisions of the Community Redevelopment Law of the State of California; and WHEREAS, City and Agency desire certain civil engineering services in relation to the Project. WHEREAS, Rick Engineering Company (Engineer) is qualified to, and desires to, render all engineering services necessary in the pursuit of the Project, as hereinafter set forth. NOW, THEREFORE, for and in consideration of the mutual covenants herein. contained and for good and sufficient considera- tion, the parties hereto do agree as follows: -1- SECTION 1 - EMPLOYMENT OF ENGINEER: Agency hereby employs engineer to render all engineering services necessary to accomplish the work hereinafter described. SECTION 2 - SCOPE OF SERVICES: Engineer shall do all things necessary to accomplish: - i 1. Prepare a scribed topographical map @ a scale of: 1" = 40'. Topography will have.one foot contour interval with spot elevations in those areas which are extremely flat. Two reductions ;•rill also be included: one at a scale of 1" - 100', and one . at a scale of 1" = 200'. The approximate limits of the topography are the subdivisions north and east of the project, Bonita Road on the south, and Highway 805 on the west. 2. Prepare a boundary survey including the 5 acre Koenig property to the east, including the de- lineation of the City of Chula Vista boundary and the County of San Diego boundary, Agency will supply Engineer with a current title report of the property involved prior to start of work to ade- quately describe the property. 3. Prepare legal descriptions and plats outlining city and county boundaries, and major land divisions.such -as the green belt open spaces and proposed Bonita Center Road. 4. Prepare a preliminary budget estimate for the street improvements, floodway improvements, major drainage improvements, and utility installations and relocations. .5. Prepare design studies to the satisfaction of the Agency and other landholders, not to exceed 3 individual studies, indicating proposed land uses, grading and proposed improvements. - 6. Prepare renderings for exhibits under the direction of the Executive Director. 7. Establish architectural design controls to, adequately describe the project. -2- Agency will instruct Engineer to proceed with each item of work under this Section. SECTION 3 - PROGRESS REPORTS: Engineer shall submit to City,and Agency, through Agency's Executive Director progress reports on 'the course of the work herein called for, at such times and in such form as the Executive Director may call for. In addition, Engineer shall confer with the Executive Director at such times and places as the Executive Director determines to be necessary to review and pursue the course of the work herein called for. SECTION 4 TIME FOR PERFORMANCE: The work herein called for shall be accomplished, following instructions to proceed, according to WORK Topographical map 2. Boundary survey 3. Legal description 4. Architectural design control • the following schedule: DAYS TO ACCOMPLISH Thirty. days Thirty days Forty-five Forty-five Forty-five Forty-five Forty-five days days days days days SECTION 5 - TERMINATION: Agency and City may, without notice and without cause, terminate work hereunder. Upon such a termination, Engineer shall render a final accounting of its work hereunder, the amount of which will' be paid to Engineer after audit and approval of Engineer's bill. SECTION 6 - FEES: Upon completion and acceptance of each item of work herein called for, Agency will pay Engineer as follows: SERVICE FEE 1. Topographical map 2. Boundary survey 3. Legal description 4. Preliminary budget 5. Design Studies 6. Renderings Current hourly rates according to Exhibit A, Not to Exceed $9,000.00 Current hourly rates according to Exhibit A, Not to Exceed $6,000.00 Current hourly rates according to Exhibit A, Not to Exceed $1,000.00 Current hourly rates according to Exhibit A, Not to Exceed $1,000.00 Current hourly rates according to Exhibit A, Not to Exceed $3,000.00 Current hourly rates according to Exhibit A, Not to Exceed $2,000.00 7. Architectural design Current hourly rates according to control Exhibit A, Not to Exceed $3,000.00 SECTION 7 - OWNERSHIP OF WORK PRODUCT: All the work product created by Engineer in the pursuit of the work herein called for shall belong to City and Agency. Upon demand, Engineer shall deliver to City and Agency said work product in whatever form it exists, including, but not limited to, maps, charts, diagrams, photographs, notes, memoranda and reports. Agency and City will reimburse Engineer for any actual costs incurred by Engineer in delivering said work product. SECTION 8 - INDEMNIFICATION - INSURANCE Engineer shall indemnify Agency and City and hold the same harmless from any claim or loss arising out of Rick Engineering Company's performance of the contract. Engineer shall deliver to Agency and City certificates of insurance evidencing the existence of insurance in favor of Engineer as follows: (a) Public liability and property damage - $300,000 combined single limits; (b) Workmen's Compensation - coverage for all employees.
