HomeMy WebLinkAboutCC RESO 11,045RESOLUTION NO. 11,04.5 A RESOLUTION URGING EXPEDITIOUS ADOPTION OF STATE. LEGISLATION AUTHORIZING PUBLIC AGENCIES. TO FIX AND COLLECT CHARGES FOR INSTALLING AND MAINTAINING FIRE. HYDRANTS WHEREAS, the water requirements of the Citizens of the City of National City are met solely by an agency independent of the City of National City, and WHEREAS, in order to protect the public health, safety and welfare, the City of San Marcos requires instal- lation of fire hydrants as a condition precedent to approval of all final parcel maps for divisions of land (lot split) in any case where such division creates a need for such hydrant, and WHEREAS, the Cityof National City presently has no legal, practical or economical means by which to apportion among owners of adjacent or benefited property such cost of installation and maintenance, and WHEREAS, the lack of such authority frequently re- sults in inequities to a landowner in undeveloped areas of the city who is first to develop his property and thereby required to install and maintain a fire hydrant, or fire hydrants, that afford protection to and benefit other properties in the area at no cost to such benefited properties, and WHEREAS, investigation has revealed that such prob- lem is continuously presented to many other cities in the state, and WHEREAS, the City of National City desires to urge expeditious enactment of state legislation authorizing any public agency that provides retail water service or that re- quires installation and maintenance of fire hydrants to fix and collect a charge for installing and maintaining fire hydrants; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City hereby determines that a present and immediate need exists for legislation that will authorize public agencies to fix, collect and apportion charges for installing and maintaining fire hydrants. J BE IT FURTHER RESOLVED that the City Clerk is directed to transmit a certified true copy of this resolution to all the legislators representing San Diego County.
