RESOLUTION OPPOSING ASSEMBLY BILL 1324
RELATING TO HORSERACING
WHEREAS, Assembly Bill No. 1324 makes amendments
to the Business and Professions Code, Section 19530, one of
which states that ". . . no municipality or county shall
adopt or enforce any ordinance or regulation which has or
may have the effect of directly or indirectly regulating,
limiting or restricting the racing days and dates of horse -
racing meetings", and
WHEREAS, said bill unduly restricts the.police
and zoning powers of municipalities and counties, and
WHEREAS, reasonably zoning regulations with legiti-
mate objectives could be held to be invalid once preempted by
the provisions of Assebly Bill No. 1324, and
WHEREAS, it is essential that local agencies retain
the power to enact and enforce reasonable zoning regulations
and that the legislature recognize this principle;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of National City hereby expresses its opposition
to Assembly Bill No. 1324..
BE IT FURTHER RESOLVED that the City Clerk is directed
to send a copy of this resolution to the legislators represent-
ing San Diego County.
