HomeMy WebLinkAboutCC RESO 11,109RESOLUTION NO. 11,109 RESOLUTION ACCEPTING COVENANT RUNNING WITH THE LAND AND DIRECTING THE RECORDING THEREOF (Joe R. Bland and Florence V. Bland) BE IT RESOLVED by the City Council of the City of National City that a Covenant granted to the City of National City by Joe R. Bland and Florence V. Bland affecting property at 2734 E. 15th Street, is hereby accepted and the City Clerk is directed to record the same. PASSED AND ADOPTED this 10th day of July, 1973. ATTEST: COVENANT RUNNING WITH THE LAND This COVENANT is made by Joe R. and Florence V. Bland hereinafter referred to as "OWNER". WHEREAS, Joe R. and Florence V. Bland is the owner of that certain real property located in the City of National City, County of San Diego, State of California, described as follows: 1/4 Sec. 106 Rancho De La Nacion Morrill Map No. 166 beginning at a point on the Southerly line of said Quarter Section bearing South 70°54' West 1458 feet from the Southeasterly corner thereof; thence North 18°58' West parallel with the Easterly line of said Quarter Section 330 feet, thence South 70°54' West parallel, with the Southerly line of said Quarter Section 66 feet; thence South 18°58' East 330 feet to a point on said Southerly line; thence North 70°54° East along said Southerly line 66 feet to the point of beginning, excepting therefrom the Southerly 165 feet and the Northerly 30 feet. WHEREAS, said owner desires to be excused from the legal requirement to install eurt7-gat4er, sidewalk d7d-Fer,9 u,Tem7pzrrrrg-forwrrewl.aif the >t:cet- ridth, on 2734 E. 15th Street NOW, THEREFORE, in consideration for the granting of a deferral to install said improvements by the City Council of the City of Notional City, said owner covenants for themselvesand _._their heirs, successors, assigns, ex- ecutors and administrators as follows: 1. The property owner will not protest the installation of any of the required improvements under a 1911 Improvement Act program whether initiated by the property owners or the City. 2. The property owner will install said improvements in conjunction with an overall improvement program of the area whether initiated by the property owners or the City. 3. Property owner will install improvements waived upon demand of City, within 30 days of demand, or City will be entitled to install said improvements and charge the owner of the burdened property therefor, and upon failure to pay said charge the City may maintain an action at law against the owner therefor. Said Covenant shall be run with and be a burden on the within described real property. DATED.
