RESOLUTION CONSENTING TO. TRANSFER AND
ANNEXATION OF PROPERTY TO CITY. OF NATIONAL CITY
(Koenig No. 3)
WHEREAS, on November 17, 1972.a petition was
presented to the City Council of the City of National City
requesting the City Council to give its consent to the
commencement of transfer and annexation proceedings in con-
nection with that certain uninhabited territory therein
referred to and generally described, which is contiguous
to the City of National City; and
WHEREAS, said petition was referred to the Plan-
ning Commission of the City of National City for investiga-
tion, report and recommendation; and
WHEREAS, the Planning Commission rendered its
report and recommendation to the Council on the 29th day
of November, 1972, favoring the commencement of transfer and
annexation proceedings; and
WHEREAS, it is the desire of the City Council to
give its consent to the commencement of such transfer and
annexation proceedings;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY:
1. That consent be and hereby is granted for the
commencement of transfer and annexation proceedings in con-
nection with said uninhabited territory in accordance with
Section 35271 of the Government Code of the State of California.
2.. That said territory be and herebyis designated
No. 3
as "KOENIG TRANSFER AND ANNEXATIO3/', and is more fully des-
cribed in Exhibit "A" attached hereto and made a part hereof
as though set forth in full.
3. The City Clerk shall certify to the adoption
of this resolution.

the Office of the County Recorder of San Diego County, LYING Easterly
of the Easterly right of way line of the State highway, said portion
described as follows:
Beginning at the Southeast corner of that Parcel of Land described
in deed to the State of California, recorded April 30, 1970, File
No. 74155, San Diego County Official Records; thence along the following
numbered courses: (1) along the Easterly line of said State land,
N.55°28'.11"W., 39.12 feet; (2) continuing along said Easterly line and
its Northerly prolongation N.10°04'36"W., 326.19 feet; (3) leaving said
Easterly line and its Northerly prolongation and along the Easterly line,
and its Northerly prolongation, of that parcel of land described in deed
to the State of California, recorded May 12, 1969, File No. 82552, San

RESERVING unto the State of California, its successors or assigns,
a temporary easement for highway slopes over and across the above de-
scribed lands LYING Easterly of said courses 9, 10 and 11 and Southerly
of said Courses 7 and 8. It is understood that said easement is tempor-
•'ary and shall terminate either upon completion of construction of the
adjacent Interstate Highway or January 1, 1976, whichever date occurs
first. It is also understood that upon said date, the State shall have
no further obligation or liability in connection with said property.
There shall be no abutter's rights of access appurtenant to the
above described real property in and to the adjacent State freeway.
The bearings and distances used in the above description are on
the California Coordinate System, Zone 6.
Subject to special assessments if any, restrictions, reservations, and easements of record.

DECLARATION OF RAY G. KOENIG IN•SUPPORT OF APPLICATION
TO DETACH 2.5 ACRE PARCEL OF VACANT LAND FROM
CHULA VISTA AND ANNEX THE SAME TO NATIONAL CITY
I, RAY G. KOENIG, declare:
That I am the President and General Manager of The Koenig
Corporation, a California corporation, and that I am authorized
to sign the foregoing application for said corporation and to
make this declaration on behalf of the same.
The subject 2.5 acre parcel of land was acquired from the
State of California by deed dated April 21, 1971 and recorded on
August 3, 1971 as F/P No. 170907, Official Records, San Diego
County, California Recorder. The Koenig Corporation is the sole
owner of said parcel of land and it is uninhabited.
The State of California filed condemnation proceedings against
said corporation to acquire property for Highway No. 805, and in
settlement thereof said corporation deeded to the State of Cali-
fornia certain property it owned and which was located in the
City of National City, and the subject parcel was acquired from
the State in partial exchange and in settlement of said proceed-
ings. Rather than pay severance damages for this -small parcel,
the State had taken full title to it in similar condemnation pro-
ceedings.
I declare under penalty of perjury that the foregoing is
true and correct.
