RESOLUTION DEFERRING REQUIREMENTS FOR INSTALLATION OF
CURB, GUTTER, SIDEWALK, AND PERMANENT PAVING FOR ONE-
HALF THE STREET WIDTH AT 2122 AND 2124 EAST 11TH STREET
(Stephens)
BE IT RESOLVED by the City Council of the City
of National City that the application of Anita L. and V.
Ray Stephens for deferral of the installation of curb,
gutter, sidewalk, and permanent paving for one-half the
Street width at 2122 and 2124 East llth Street is granted
subject to the following conditions:
1. The deposit of security with the City
Treasurer of the City of National City in the form of
cash or bond in an amount sufficient to insure the in-
stallation of said improvements at the end of the deferral
peiod. The amount of said security deposit shall be equal
to the City Engineer's estimate of cost of placing the
minimum improvements on all public street frontage accessible
to said property; or
2. The filing with the Planning Department of
the City of National City a covenant running with the land,
providing:
a. The property owner will not protest the
installation of any of the required improvements under a
1911 Improvement Act program whether initiated by the
property owners or the City; and
b. The property owners will install said
improvements in conjunction with an overall improvement
program of the area whether initiated by the property owners
or the City.
PASSED AND ADOPTED this 3rd day of October, 1972.

COVENANT RUNNING WITH LAND
This COVENANT is made by Anita L. and V. Ray
Stephens, hereinafter referred to as "OWNERS."
WHEREAS, Anita L. and V. Ray Stephens are the.
owners of that certain real property located in the City
of National City, County of San Diego, State of California,
described as follows:
Lot 30 of Hills of Paradise, according to Map
thereof No. 1860, filed in the Office of County
Recorder of San Diego County, September 23, 1925.
WHEREAS, said owners desire to be excused frcm
the legal requirement to install curb, gutter, sidewalk,
and permanent paving for one-half the street width at 2122
and 2124 East llth Street;
NOW, THEREFORE, in consideration for the granting
of a deferral to install said improvement by the City Council
of the City of National City, said owners covenants for them-
selves and their heirs, successors, assigns, executors and
administrators as follows:
1. The filing with the Planning Department of the
City of National City of a covenant running with the land
providing:
a. The property owner will not protest the
installation of any of the required improvements under a 1911
Improvement Act program whether initiated by the property
owners or the City.
b. The property owner will install said im-
provements in conjunction with an overall improvement program
of the area whether initiated by the property owner or the City.
Said Covenant shall be run with and be a burden on
the within described real property.
