HomeMy WebLinkAboutCC RESO 10,850RESOLUTION NO. 10,850 RESOLUTION DEFERRING REQUIREMENTS FOR INSTALLATION OF GUTTER AT 910 EAST SEVENTH STREET (Fred Scott) BE IT RESOLVED by the City Council of the City of National City that the application of Fred Scott for deferral of the installation of gutter at 910 East Seventh Street is granted subject to the following conditions: 1. A covenant running with the land be obtained not to protest the application of the 1911 Improvement Act; and, 2. The property owner to bear the costs of im- provements whether initiated by the property owners or the City; and, 3. The applicant post a cash bond in the amount of $150.00 with the City Treasurer of National City to cover costs of said improvements. PASSED AND ADOPTED this 10th day of October, 1972. WHEREAS, Fred Scott hereinafter referred to as is the owner of that certain real property located in the City of National City, County of San Diego, State of California, described as follows: The Easterly 50 feet of the Westerly 100 feet of the Northerly Half of Block 7 of Plat of Subdivision of 20 Acre Lot 4 in Quarter Section 131 of Rancho de la Nacion made by Copeland as Map Number 615 filed in the office of the County Recorder of San Diego County on October 7, 1889. WHEREAS, said owner desires to be excused from the legal requirement to install curb, gutter, sidewalk and permanent paving for one-half the street width, on 910 East Seventh Street NOW, THEREFORE, in consideration for the granting of a deferral to install said improvements by the City Council of the City of National City, said owner covenants for ._himself_.. and his heirs, successors, assigns, ex- ecutors and administrators as follows: 1 The property owner will not protest the installation of any of the required improvements under a 1911 Improvement Act program whether initiated by the property owners or the City. 2. The property owner will install said improvements in conjunction with an overall improvement program of the area whether initiated by the property owners or the City. 3. The applicant post a cash bond in the amount of $150.00 with the City Treasurer of National City to cover costs of said improvements. Said Covenant shall be run with and be a burden on the within described real property.
