HomeMy WebLinkAboutCC RESO 10,673RESOLUTION NO. 10673 RESOLUTION OPPOSING SENATE BILL 874 RELATING TO LIABILITY OF PUBLIC ENTITIES WHEREAS, it:appears that Senate Bill 874 if passed will override and nullify the immunity provisions of Govern- ment Code Sections 818.6 and 821.4, which local governmental jurisdictions have long enjoyed, and WHEREAS, every effort is made to obtain inspection personnel of the highest moral character and greatest knowledge and skills, and WHEREAS, on -the -Job training programs have been in- stituted to keep these qualifications at the highest level, and WHEREAS, except in cases of fraud or malfeasance, the building official has by statute heretofore been relieved of liability for damage accrued to persons or property as the result of any act or omission in the discharge of his duties, and WHEREAS, Senate Bill 874 presentsan impending loss of governmental immunity from liability through Code enforce- ment activities: NOW, THEREFORE, BE IT RESOLVED that the City Council of National City vigorously opposes passage of Senate 'Bill 874 which will result in serious financial hardship to cities through the loss of immunityfrom liability for the public em- ployee while in the discharge of his duties.
