HomeMy WebLinkAboutCC RESO 10,719RESOLUTION NO. 443—,405 RESOLUTION WAIVING REQUIREMENTS FOR INSTALLATION OF CURB, GUTTER, SIDEWALK, AND PERMANENT PAVING FOR ONE. - HALF THE STREET WIDTH AT 505 RACHAEL AVENUE (Lewis & Anna Jerdo) BE IT RESOLVED by the City Council of the City of National City that the application of Lewis & Jerdo for deferral of the installation of curb, gutter, sidewalk, and permanent paving for one-half the street width at 505 Rachael Avenue is granted subject to the following conditions: 1. A covenant be obtained running with the land not to protest the 1911 Improvement Act. 2.. Property owner to bear the cost of improvements whether initiated by property owners or the City. PASSED AND ADOPTED this llth day of July,' 1972.. ATTEST: COVENANT RUNNING WITH LAND This COVENANT is made by ANNA JERDO and LEWIS W. JERDO, husband and wife as joint tenants, hereinafter referred to as "OWNERS". WHEREAS, ANNA JERDO and LEWIS W. JERDO are the owners of that certain real property located in the City of National City, County of San Diego, State of California, described as follows: PARCEL 1: Portion of the Southwest Quarter of Quarter Section 104 at Rancho de la Nacion, according to Map thereof by Morrill, No. 166, together with utility, ingress and egress easements. All that portion of the Westerly 330.00 feet of the Southwest Quarter of Quarter Section 104 of Rancho de la Nacion, in the County of San Diego, State of Cali- fornia, according to Map thereof by Morrill, No. 166, filed in the office of the County Recorder of said San Diego County, lying Southerly of the Easterly prolongation of the Southerly line of Lot 61 of Rancho Hills Unit No. 5, accord- ing to Map thereof No. 2475, filed in the office of the County Recorder of said San Diego County, and Northerly of the Easterly prolongation of the Southerly line of Lot 64 of said Rancho Hills Unit No. 5, and Easterly of the most Easterly line of said Rancho Hills Unit No. 5. EXCEPTING THEREFROM the Southerly 170.00 feet thereof. WHEREAS, said owners desire to be excused from the legal requirement to install curb, gutter, sidewalk, and permanent paving for one-half the street width at 505 Rachael Avenue; NOW, THEREFORE, in consideration for the granting of a deferral to install said improvements by the City Council of the City of National City, said owners covenant for them- selves and their heirs, successors, assigns, executors and administrators as follows: 1. The filing with the Planning Department of the City of National City of a covenant running with the land providing: a. The property owner will not protest the installation of any of the required improvements under a 1911 Improvement Act program whether initiated by the property owners or the City. b. The property owner will install said improvements in conjunction with an overall improvement program of the area whether initiated by the property owners of the City. Jerdo, personally known to her to be the same persons described in and whose names were subscribed to the within and annexed instrument as executing Party thereto, exe- cute and deliver the same, and they acknowledged to said affiant that they executed the same; and that said affiant subscribed her name thereto as a Witness.
