RESOLUTION WAIVING REQUIREMENTS FOR INSTALLATION
OF CURB, GUTTER, SIDEWALK AND PERMANENT PAVING FOR
ONE-HALF THE STREET WIDTH, ON 17TH STREET, AT
3042-3046 1/2 EAST 16TH STREET

BE IT RESOLVED by the City Council of the City
of National City that the application of Allen L. Gunn
for deferral of the installation of curb, gutter, sidewalk
and permanent paving for one-half the street width, on
17th Street, at 3042-3046 1/2 East 16th Street is granted
subject to the following conditions:
1. A covenant running with the land be obtained
not to protest the installation of subject improvements
under a 1911 improvement Act whether initiated by the
property owners or the City.
2. A 20-ft. parcel at Southerly end of property
be dedicated to the City of National City as right-of-way
for 17th Street.
3. Grant a 5-ft. slope easement at Southerly
end of property or a letter of permission in lieu of ease-
ment.
PASSED AND ADOPTED this llth day of July, 1972.

COVENANT RUNNING WITH LAND
This COVENANT is made by ALLEN L. GUNN, hereinafter
referred to as "OWNER".
WHEREAS, Allen L. Gunn is the owner of that certain
real property located in the City of National City, County
of San Diego, State of California, described as follows:
Lot 221 of Lincoln Acres Annex No. 2 according
to the Map thereof No. 1748 filed in the office
of the Recorder of the County of San Diego State
of California on February 7, 1923.
WHEREAS, said owner desires to be excused from the
legal requirement to install curb, gutter, sidewalk and
permanent paving for one-half the street width, on 17th
Street, at 3042-3046 1/2 East 16th Street;
NOW, THEREFORE, in consideration for the granting
of a deferral to install said improvements by the City Council
of the City of National City, said owner dovenants for himself
and his heirs, successors, assigns, executors and administrators
as follows:
1.
The property owner will not protest the installation
of any of the required improvements under a 1911 Improvement Act
program whether initiated by the property owners of the City.
2, The property owner will install said improvements
in conjunction with an overall improvement program of the area
whether initiated by the property owner or the City.
3. A 2Q-ft. parcel at Southerly end of property be
dedicated to the City of National City as right-of-way for
17th Street.
4, Grant a 5-ft. slope easement at Southerly end of
property or a letter of permission in lieu of easement.
Said Covenant shall be run with and be a burden on the
within described real property.
