RESOLUTION WAIVING REQUIREMENTS FOR INSTALLATION
OF GUTTER AT 1121 EAST SIXTH STREET
(Harris Howell)
BE IT RESOLVED by the City Council of the City
of National City that the application of Harris Howell for
deferral of the installation of gutter at 1121 East Sixth
Street is granted subject to the following conditions:
1. A covenant running with the land be obtained
not to protest the application of the 1911 Improvement Act.
2. The property owner to bear the costs of
improvements, whether initiated by the property owners or
the City.
PASSED AND ADOPTED this llth'day of July, 1972.

COVENANT RUNNING WITH LAND
This COVENANT is made by HARRIS HOWELL, hereinafter
referred to as "OWNER."
WHEREAS, Harris Howell is the owner of that certain
real property located in the City of National City, County
of San Diego, State of California, described as follows:
The Easterly fifty feet of the Westerly one
hundred fifty feet of the Southerly Half of
Block 13 of Copeland's Subdivision of the
Southerly Half of Twenty Acre Lot Three in
Quarter Section One Hundred Thirty One of
the Rancho de la Nacion, according to the
Map thereof No. 614, filed in the office of
the Recorder of said San Diego County,
October 7, 1889.
WHEREAS, said owner desires to be excused from the
legal requirement to install gutter at 1121 East Sixth Street;
NOW, THEREFORE, in consideration for the granting of
a deferral to install said improvements by the City Council
of the City of National City, said owner covenants for himself
and his heirs, successors, assigns, executors and administrators
as follows:
1. The property owner will not protest the installation
of any of the required improvements under a 1911 Improvement Act
program whether initiated by the property owners of the City.
2. The property owner will install said improvements
in conjunction with an overall improvement program of the area
whether initiated by the property owner or the City.
Said Covenant shall be run with and be a burden on the
within described real property.
