HomeMy WebLinkAboutCC RESO 10,736RESOLUTION NO. 10,736 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE APPROPRIATE COUNTY OFFICERS OF THE COUNTY OF SAN DIEGO TO CANCEL UNCOLLECTED TAXES PURSUANT TO REVENUE AND TAXATION CODE SECTION 4986 WHEREAS, Section 4986 of the Revenue and Taxation Code of the State of California authorizes the Board of Supervisors of San Diego County with the written consent of the County legal advisor to order the cancellation by the County Auditor of all or any portion of any uncollected tax, penalty or costs heretofore or hereafter levied upon satisfactory proof that it was improperly levied or charged; and WHEREAS, said Section sets forth standards by which the improper levy or charge of tax, penalty or costs is de- termined; and WHEREAS, said Section provides that cancellation of all or any portion of any tax, penalty, or costs collectible by County officers on behalf of a municipal corporation may be made without the written consent of the City Attorney or other officer designated by the City Council if a resolution by the City Council is filed with the Board of Supervisors authorizing cancellation by county officers, which resolution shall remain effective until rescinded by the City Council; and WHEREAS, the City Council of the City of National City has determined that the determination of satisfactory proof is carefully made by the County officers making such determination and that such a resolution will facilitate the work of county officials and benefit both the county and the city; NOW THEREFOR IT IS HEREBY RESOLVED by the City Council of the City of National City that appropriate County officers as designated in the resolution of the Board of Supervisors of the County of San Diego dated March 30, 1971 (Minute Order 56) are hereby authorized to cancel all or any portion of any uncollected tax, penalty or costs upon property located within the City of National City which are collectible by County officers of the County of San Diego. The consent of the City Attorney for such cancellation shall not be necessary. IT IS FURTHER RESOLVED that the City Clerk shall file a certified copy of this resolution with the Board of Supervisors of the County of San Diego. PASSED AND ADOPTED this 18th day of July, 1972.
