A RESOLUTION AUTHORIZING EXECUTION OF AN
AGREEMENT BETWEEN THE NATIONAL SCHOOL
SCHOOL DISTRICT AND THE CITY OF NATIONAL
CITY
BE IT RESOLVED by the City Council of the City
of National City that the Mayor of National City is here-
by authorized and directed to execute an Agreement between
the National School District and the City of National City
Re Improvements on Euclid Avenue, 22nd Street and Ridge-
way Drive in National City.
PASSED AND ADOPTED this 25th day of July, 1972.

THIS AGREEMENT is made and entered into by and between the National
School District, hereinafter referred to as "DISTRICT", the City of
National City, a municipal corporation hereinafter referred to as "CITY".
WHEREAS, DISTRICT owns property in the City of National City which
will be affected by the CITY'S Proposed street improvements; and
WHEREAS, CITY desires to make certain street improvements which will
benefit the Community at large as well as both of the parties hereto; and
WHEREAS, this Agreement is authorized under the provisions of the
Government Code, Section 6500 et seq. as a joint exercise of powers
which are common to the contracting powers; and
WHEREAS, DISTRICT is authorized pursuant to Education Code,
Section 16251 et seq. to dedicate or convey to a municipal corporation
for public street or highway purposes any real property belonging to
the District, either in fee or any lesser estate or interest therein;
NOW THEREFORE
IT IS HEREBY MUTUALLY AGREED BY AND BETWEEN THE PARTIES HERETO AS
FOLLOWS:
A. Subject to DISTRICT'S completion 6-0---the procedures required
by Education Code, Section 16251 et seq. and dedication or
conveyance to City of the real property hereinafter described,
CITY will take the following actions:
1. Remove the existing wood and chain link fence along the
Westerly and Southerly extensions of the existing Lincoln
Acres Elementary School Playground.
2. Install a new six foot chain link fence along the new
Westerly property line as shown on Engineer's Drawing
485-B, a copy of which is attached, hereto marked
Exhibit 1. Said fence to be of at least same quality

and gauge as existing chain link fence.
3. Install a new six foot chain link fence along the new
Southerly property line as shown on Engineer's Drawing
485-8, Exhibit 1. Said fence to be of at least same
quality and gauge as existing chain link fence.
4. Install_a manual sprinkler system along the bottom of
the new chain link fence described in Note 2 above.
5. Install a reinforced concrete block wall ten feet Easterly
of the new Westerly property line from the intersection of
the existing East-West slope (Sta. 3+90 more or less) to
Sta. 10+50 per Engineer's Drawing 485-3, and continuing
said wall in a Southerly direction to the intersection with
the new Southwesterly corner of said Lincoln Acres Elementary
School. Said wall to be four feet in minimum heighth between
Sta. 3+90 and Sta. 10+50 per Engineer's Drawing 485-8. Said
wall to be two feet in minimum heighth between Sta. 10+50 and
the intersection with the new Southwesterly corner of said
Lincoln Acres Elementary School.
6. Install an underground storm drain perpendicular to the new
Westerly property line of said Lincoln Acres Elementary School
at Sta. 6+81 more or less per Engineer's Drawing 485-3.
7. Install a P.C.C. stairway opposite 22nd Street, five feet in
width with one landing and hand rails.
8. Install an inlet for drainage purposes at the Northerly side
of the proposed stairway.
9. Replace any damaged planting and install new planting on all
new slopes. Said new planting shall be of the same variety
as existing planting or of a similar nature.
10. Rework the existing inlet for drainage purposes at Sta. 8+65
into a cleanout.

11. Install an inlet for drainage purposes at the new Southwesterly
corner of said Lincoln Acres Elementary School.
12. Install a gateway adjacent to the stairway as described in
Note 7 above. No gate to be installed.
13. Install sidewalk, curb, gutter and street paving along the
entire Euclid Avenue frontage of Lincoln Acres Elementary
School.
14. Grant to the National School District that portion of 24th
Street to be closed to public use. The legal description
is contained in the copy of a deed attached hereto as Exhibit 2.
15. It is to be understood that time is important and work will
proceed, once started, in such a manner as to afford the least
amount of loss of use of the school grounds to the District.
16. Pay for the costs of advertising the proposed notice of
conveyance of property to the City.
B. District to grant a Temporary Working Easement or letter of permission
to the City of National City, its agents or assigns to do the work
necessitated by these improvements of Euclid Avenue - 22nd Street to
24th Street prior to City's starting project.
C. Subject to CITY'S completion of the actions specified in Paragraph A
above, DISTRICT will take the following actions:
1. Grant to the City of National City for Street purposes a 20
foot strip along the Westerly line of said Lincoln Acres Ele-
mentary School. The legal description is contained in the
copy of the deed attached hereto as Exhibit A.
2. Grant a Drainage Easement to the City of National City at Sta.
6+81 more or less as shown on Engineer's Drawing 454-B. The
legal description is contained in the copy of the deed attached
hereto as Exhibit B.
3. Grant a Drainage Easement to the City of National City at the
new Southwesterly corner of said Lincoln Acres Elementary School.
The legal description is contained in the copy of the deed

attached hereto as Exhibit C.
4, Maintain the above described fencing, sprinkler system and
wall to be on National School District property upon com-
pletion of the Euclid Avenue Improvement Project in a workman
like manner.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed on the dates opposite their respective signatures.

National City, County of San Diego, State of California, according to Map
thereof by George Morrill, No. 166, filed in the office of the County Recorder
of said San Diego County, May 11, 1869, described as follows:
