Home My WebLink AboutCC RESO 10,743RESOLUTION NO. 10,743 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY AND THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM TO PERMIT THE INCLUSION OF ONE-HALF CONTINUANCE BENEFITS FOR THE PUBLIC SAFETY FIRE PERSONNEL ONLY, UNDER THE PROVISIONS OF SECTION 21264 OF THE GOVERNMENT CODE, EFFECTIVE ON JULY 1, 1972. The City council of the City of National City does hereby resolve as follows: WHEREAS, the City Manager has met and conferred in good faith with the National City Fireman's Association as required by the Meyers-Milias-Brown Act of the State of California (Govern- ment Code Section 3500); and, WHEREAS, the City Council unanimously approved a recom- mendation by the City Manager at its meeting on June 27, 1972, granting the One -Half Continuance Fire personnel; and, WHEREAS, the Public Employees' Retirement Law permits the participation of public agencies and their employees in the Public Employees' Retirement System by the execution of a con- tract, and sets forth the procedure by which said public agencies may elect to subject themselves and their employees to amendments to said law; and, WHEREAS, one step in said procedure is the adoption by the legislative body of the public agency of a resolution giving notice of its intention to approve an amendment to said contract, which resolution shall contain a summary of the changes proposed in said contract; and, WHEREAS, the following is a statement of the proposed benefit to all Public Safety change: One -Half Continuance providing that upon the death of a local safety member after retirement for service or indus- trial disability one-half of his retirement allowance shall be continued to his surviving wife, provided she was married to him at least one year prior to retirement, throughout her life or until remarriage. Should there be children under the age of eighteen but no surviving wife, or the surviving wife has died or remarried, then one-half of his retirement allowance shall be continued to said children while they are unmarried and under the age of eighteen. Should there be no surviving wife and no surviving children under the age of eighteen then a surviving parent or parents dependent on him for support may collectively receive one- half of his retirement allowance throughout their lives (Government Code Section 21264). NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City, hereby gives notice of its inten- tions to approve an amendment to the contract between the City and the Board of Administration of the Public Employees' Retire- ment System as indicated in this Resolution.
