HomeMy WebLinkAboutCC RESO 10,745RESOLUTION NO. 10,745 RESOLUTION GRANTING A CONDITIONAL USE PERMIT (Intercontinental Cinemas Corp. and Abe Bukow) The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. At a regular meeting of the City Planning Commission on June 12, 1972, said Commission unanimously adopted a recommendation that the owners of the real property located at 1001 Harbison Avenue, be granted a Conditional Use Permit upon the conditions hereinafter stated. 2. That the City Council has received the recommendation of the Planning Commission, and after full and complete consideration of said recommendation hereby grants a Conditional Use Permit for the proposed Twin Theatre at 1001 Harbison Avenue subject to the following terms and conditions: a. Prior to City Council adoption of resolution authorizing the issuance of a conditional use permit, the applicant shall file a written statement, in the form to be prescribed by the City Attorney, with the Planning De- partment, acknowledging and accepting all of the conditions imposed upon the conditional use permit. b. If the use permitted pursuant to the grant of said conditional use permit is not exercised within a period of time not exceeding one (1) year from date of City Council adoption of resolution granting conditional use permit, or use is discontinued for a period of one year, said permit shall be deemed null and void. c. A minimum of sixty-eight (68) off-street parking sites shall be allocated for the subject use. Said sites shall be permanently and adequately maintained. d. Use authorized is specifically for the showing of films. Hours of operation shall be prohibited between 1:00 a.m. and 9:00 a.m. All-night showing of films shall be prohibited. e. Signs shall be approved by the City Council upon recommendation of the Planning Commission, as provided in Section 12-2, Ordinance No. 1112. f. Maximum occupant load permitted shall be as follows: (a) Cinema - 1 (b) Cinema - 2 Total 1 & 2 352 seats 326 seats 678 seats g. Development shall be in accordance with plans on file in the Planning Department. h. Said permit shall be subject to revocation whenever the City Council finds, upon recommendation of the Planning Commission, that any of the following facts exists: (1) That the same was obtained by fraud; or, (2) That the use authorized has ceased, or has been suspended, for any reason, for a period of six (6) months or more; or, (3) That the subject permit is being exercised in a manner contrary to law or conditions of approval of said permit; or, (4) That the use authorized by said permit is being, or has been, exercised in a manner detrimental to public peace, health, safety, or welfare, or in a manner to constitute the same a public nuisance.
