HomeMy WebLinkAboutCC RESO 10,751RESOLUTION NO. 10,751 RESOLUTION GRANTING A RESIDENTIAL PLANNED DEVELOPMENT PERMIT PURSUANT TO ORDINANCE 1077 (No. 48 - McMillin's Bonita Park, Unit No. 1 - Corky McMillin) The City Council of the City of National City, California, does hereby find, determine, order and resolve as follows: 1. At a regular meeting of the City Planning Com- mission on June 26, 1972, said Commission unanimously adopted a recommendation that the owner of the real property known as East Sweetwater Road and more fully described in Exhibit "A" attached hereto and made a part hereof as though set forth in full, be granted a Residential Planned Development Permit upon the conditions hereinafter stated: 2. That the City Council has received the recom- mendation of the Planning Commission, and after full and complete consideration of said recommendation hereby grants a Residential Planned Development Permit to construct a pro- posed Unit 1, McMillin's Bonita Park subject to the following terms and conditions: a. Prior to City Council adoption of Resolution granting Residential Planned Unit Development Permit No. 48, the property owner or his authorized agent shall first: (1) File with the Planning Department an acknowledgment in writing stating that he is aware of, and accepts, all of the conditions of approval as hereinbelow set forth. (Acceptance form available from Planning Department) b. Prior to the issuance of a building permit by the Department of Building and Housing, City of National City, for any portion of the development authorized by the issue of this permit, the property owner shall first: (1) File and record a subdivision map in accordance with existing city law and Subdivision Map Act of State of California; and, (2) Provide a declaration of Covenants, conditions and restrictions, and responsibilities, including maintenance, payment of taxes, etc., involved in said common ownership. Said covenants, conditions, and restrictions shall be subject to approval as to content and form by the City Attorney and the City Council, upon recommendation of the Planning Commission; and, (3) Enter into an agreement with the City whereby in consideration of approval by of National City, said City of the planned residential development, the developer agrees to complete the installation of all improvements and other work required by the City in accordance with the approved plans, or approved unit thereof. (4) To assure the City that this work will be completed and lien holders paid, the developer shall furnish the City with either: A bond guaranteeing faithful performance of the agreement and guaranteeing payment for labor and materials; or, A trust agreement evidencing that the estimated cost of the work or improvements has been deposited with an approved trustee. (5) The amount of such bond or cash deposited shall be determined by the City Engineer and approved by the City Council as to amount and adequacy. (6) Property owners to work with the City Engineer in obtaining adequate City sewer connection facilities. c. Property line separation wall shall have a fire resistant rating of two hours - (1) No through penetration of separation wall shall be allowed. (2) Separation wall shall extend continuously from foundation to roof sheathing. (3) Protect ends of two-hour walls, one hour equal to any depth of any projecting elements. d. Each unit shall maintain its individual water meter and electrical meter. Sewer service to each building complex by privately owned and maintained sewer lateral or laterals. e. All common recreational areas, including children's play area and tot lot, shall be shown as separate lots on the recorded subdivision map. f. Construction shall commence within 360 days after the date of the resolution adopted by City Council granting Residential Planned Unit Development Permit No. 48. g. A development phasing: (to be fully completed within these dates) Phase I Recreation Building, Pool & Buildings 2 & 3 9/1/73 Phase II Buildings 4 & 5 12/1/73 Phase III Buildings 6, 7 & 8 2/1/74 Phase IV Buildings 9 & 10 6/1/74 Phase V Buildings 11 & 12 12/1/74 h. Off-street parking facilities, including access, circulation and arrangement shall be installed and maintained in accordance with Appendix "A" of City Ordinance No. 1306. (1) Off-street parking shall be provided at a minimum ratio of two sites per dwelling unit. (2) Parking within the cul-de-sac shall be prohibited. (3) Parking shall be prohibited along main access road, on side where fire hydrants are located. (4) All off-street parking areas and drive- ways incidental thereto, except required driveway approaches on public property, shall be surfaced with minimum four inch (4") thick Portland cement concrete or paved with minimum three inch (3") thick asphalt surfacing or minimum two inch (2") thick asphalt surfacing over a four inch (4") base of compacted material approved by the City Engineer. All such paving shall thereafter be properly maintained. i. A landscape plan shall be submitted to and approved by the Director of Parks and Recreation, and shall provide: (1) That all slopes are planted and land- scaped with adequate coverage so as to prevent erosion and bare spots. (2) That the areas of parkways not included within the sidewalk or driveway are planted and maintained with ivy, grass or other approved ground covering. (3) That trees, approved as to number, size and specie by the Director of Parks and Recreation, shall be installed between buildings and interior roadways. (4) Trees, approved as to number, size and specie by the Director of Parks and Recreation, shall be installed along Sweetwater Road frontage. j. Adequate street lighting shall be provided by the installation of mercury vapor ornamental street lights. (1) Location and wattage of mercury vapor lights to be in accordance with that recommended by Street Lighting Coordinator, San Diego Gas & Electric Company. k. Outdoor security lighting for walks, steps, parking areas, driveways, and other facilities shall be pro- vided. Fixtures used to provide such lighting shall be in keeping with the type of development and at locations to assure safe and convenient nighttime use. 1. Site development shall be in accordance with the plans on file in the Planning Department and all applicable provisions of City Ordinance 1306. m. Street dedication shall be made by the property owners for the widening of Sweetwater Road. Amount of dedication to be determined by the City Engineer. n. Noncompliance with conditions of this agree- ment shall constitute a violation of the Zoning Ordinance of the City of National City. PASSED AND ADOPTED this 25th day of July,1972. ATTEST: EXHIBIT "A" All those portions of Quarter Section 100 of Rancho de la Nacion, in the City of National City, Count7 of San Diego, State of California, according to Map thereof No. 166, made by Morrill, filed in the Office of the County Recorder of San Diego County, May 11, 1869, and of Lots 65 and 66 of Sweetwater Heights according to the Map thereof No. 4805 filed in said Recorder's Office June 30, 1961, described as follows: Beginning at the most Southerly corner of Lot 14 said Sweetwater Heights; thence South 57°46' West along boundary of said Sweetwater Heights 31.19 feet to an angle point in said boundary, being also a point on the Northerly line of County Road Survey No. 1323, a plat of which is on file in the County Engineer's Office of said San Diego County; thence continuing South 57°46' West along the prolongation of said boundary of Sweetwater Heights to the intersection with the center line of said Road Survey No. 1323 and the TRUE POINT OF BEGINNING; thence retracing North 57°46' East along said prolongation to said angle point in the boundary of Sweetwater Heights; thence continuing North 57°46' East along said boundary 647.09 feet to an angle point therein; thence South 71°41' East along said boundary 365.05 feet to the Southwesterly corner of Lot 65 of said Sweetwater Heights; thence North 9°12'05" West along the Westerly line of said Lot 65 a distance of 32.00 feet; thence in a straight line to a point on the Northeasterly line of said Lot 65 distant thereon North 53°46'05" West 112.00 feet from the most Easterly corner of said Lot 65; thence South 53°46'05" East along said North- easterly line and its Southeasterly prolongation 136.17 feet; thence South 1°08'31" West 405.78 feet, more or less to the intersection with the center line of said Road Survey No. 1323; thence Northwesterly along said center line to the TRUE POINT OF BEGINNING.
