RESOLUTION DEFERRING REQUIREMENTS FOR INSTALLATION
OF CURB, GUTTER, SIDEWALK AND PERMANENT PAVING FOR
ONE-HALF THE STREET WIDTH, ON 17TH STREET, AT 3042-
3046 1/2 EAST 16TH STREET

BE IT RESOLVED by the City Council of the City
of National City that the application of Agnes C. Gunn for
deferral of the installation of curb, gutter, sidewalk and
permanent paving for one-half the street width, on 17th
Street, at 3042-3046 1/2 East 16th Street is granted sub-
ject to the following conditions:
1. A covenant running with the land be obtained
not to protest the installation of subject improvements
under a 1911 Improvement Act whether initiated by the
property owners or the City.
2. A 20-ft. parcel at Southerly end of property
be dedicated to the City of National City as right-of-way
for 17th Street.
3. Grant a 5-ft. slope easement at Southerly
end of property or a letter of permission in lieu of ease-
ment.
PASSED AND ADOPTED this 1st day of August, 1972.

COVENANT RUNNING WITH LAND
N.C. Res. 10,752
This COVENANT is made by AGNES C. GUNN, hereinafter referred
to as "OWNER".
WHEREAS, Agnes C. Gunn is the owner of that certain real pro-
perty located in the City of National City, County of San Diego, State
of California, described as follows:
Lot 221 of Lincoln Acres Annex No. 2 according to the Map thereof
No. 1748 filed in the office of the Recorder of the County of San
Diego State of California on February 7, 1923.
WHEREAS, said owner desires to be excused from the legal re-
quirement to install curb, gutter, sidewalk and permanent paving for
one-half the street width, on 17th Street, at 3042-3046 1/2 East 16th
Street;
NOW, THEREFORE, in consideration for the granting of a defer-
ral to install said improvements by the City Council of the City of
National City, said owner covenants for herself and her heirs, successors,
assigns, executors and administrators as follows:
1. The property owner will not protest the installation of
any of the required improvements under a 1911 Improvement Act program
whether initiated by the property owners or the City.
2. The property owner will install said improvements in
conjunction with an overall improvement program of the area whether
initiated by the property owner or the City.
3. A 20-ft. parcel at Southerly end of property be dedicated
to the City of National City as right-of-way for 17th Street.
4. Grant a 5-ft. slope easement at Southerly end of property
or a letter of permission in lieu of easement.
Said Covenant shall be run with an be a burden on the within
described real property. (�

On 'July 26, 1972, before me, the undersigned, a Notary Public in and
for said State, personally appeared Ione Minogue Campbell personally
known to me to be the person whose name is subscribed to the within
instrument, as a Witness thereto, who being by me duly sworn, deposes
and says: That she resides in National City and that she was present
and saw Agnes C. Gunn, personally known to her to be the same person
described in and whose name was subscribed to the within and annexed
instrument as executing Party thereto, execute and deliver the same,
and she acknowledged to said affiant that she executed the same;
and that said affiant subscribed her name thereto as a Witness.
