RESOLUTION APPROVING LOT SPLIT (TENTATIVE PARCEL
MAP) AT 2904 AND 2910 E. SIXTEENTH STREET

BE IT RESOLVED by the City Council of the City
of National City that the recommendation of the Planning
Commission of National City regarding the lot split at
2904 and 2910 E. Sixteenth Street, be approved and that
said approval is conditioned upon the following:
1. That the southerly 20 feet of Lot 212 be given
to the City for street dedication and that such dedication
shall be completed prior to the filing of the Parcel Map.
2. That the requirement for curb, gutter, side-
walk and 1/2 street paving on 17th Street be waived subject
to the filing with the Planning Department of a covenant
running with the land providing:
a. The property owner will not protest the
installation of any of the required improvements under a
1911 Improvement Act program whether initiated by the
property owners or the City; and,
b. The property owners will install said
improvements in conjunction with an overall improvement
program of the area whether initiated by the property owners
or the City.
3. That the covenant apply only to the southerly
parcel.
4. That the parcels be numbered or lettered.
5. That within one year from the date of approval
of this. lot split the applicant shall file with the County
Recorder a parcel map, approved by the City Engineer, in
substantial conformance with the approved lot split map and
in conformance with the State Subdivision Map Act.
6. That the requirement that separate and individual
sanitary sewer facilities and connections be made to each lot
created be waived, but that no building permit for the south-
erly parcel be issued prior to the installation of an approved
private sewage disposal system.

COVENANT RUNNING WITH LAND
This COVENANT is made by F. James Bear, herein-
after referred to as "OWNER".
WHEREAS, F. James Bear is the owner of that
certain real property located in the City of National City,
County of San Diego, State of California, described as
follows:
The Northerly 123 feet of the Southerly
143 feet of Lot 212, Lincoln Acres Annex
Number 2, according to the Map thereof
Number 1748, filed in the office of the
County Recorder of said San Diego County,
February 7, 1923. Excepting therefrom
the Easterly 1 foot thereof.
WHEREAS, said owner desires to be excused from
the legal requirement to install permanent curb, gutter,
sidewalk and 1/2 street paving on 17th Street;
NOW, THEREFORE, in consideration for the granting
of a deferral to install said improvements by the City Council
of the City of National City, said owner covenants for himself
and his heirs, successors, assigns, executors and administrators
as follows:
1. The filing with the Planning Department of the
City of National City of a covenant running with the land
providing:
a. The property owner_will not protest the
installation of any of the required improvements under a
1911 Improvement Act program whether initiated by the
property owners or the City;•and,
b. The property owners will install said
improvements in conjunction with an overall improvement
program of the area whether initiated by the property owners
or the City.
c. That the covenant apply only to the
southerly parcel.
Said Covenant shall be run with and be a burden
on the within described real property.
