A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF NATIONAL CITY AUTHORIZING
THE EXECUTION OF AMENDMENT NO. 2 TO
THE LOCAL GRANT-IN-AID AND COOPERA-
TION AGREEMENT BY AND BETWEEN THE
CITY OF NATIONAL CITY AND THE REDEVELOP-
MENT AGENCY OF THE CITY OF NATIONAL
CITY FOR THE E. J. CHRISTMAN BUSINESS
AND INDUSTRIAL PARK I, PROJECT NO.
CALIF. R-127
WHEREAS, in connection with the undertaking of the E. J.
Christman Business and Industrial Park I, Project No. Calif. R-127
there will be certain expenses; and
WHEREAS, the Redevelopment Agency has applied to the Sec-
retary of Housing and Urban Development for financial assistance under
Title I of the Housing Act of 1949, as amended; and
WHEREAS, there are certain costs to be incurred in connec-
tion with the project which are not eligible for Federal financing;
and
WHEREAS, the Redevelopment Agency at this time does not
have a source of funds to defray the local cost of project activities;
and
WHEREAS, Section 33220 of the Health and Safety Code, State.
of California, authorizes the Agency to enter into agreements with
public bodies respecting action to be taken pursuant to the Community
Redevelopment Law; and
WHEREAS, the City and the Agency entered into a Local Grant -
In -Aid and Cooperation Agreement on January 28, 1970 which provides,
among other things, for the City to assist the Agency financially and
otherwise in completing the redevelopment project; and
WHEREAS, the Council of the City of National City has
enlarged the project area and modified the official Redevelopment Plan;
and
WHEREAS, the modification to the project required an adjust-
ment in the City's obligations to and participation in completing
the project, and an Amendment No. 1 to the Cooperation Agreement was
executed March 29, 1972; and
WHEREAS, the City Council of the City of National City
approved a final street pattern for the project by adopting Resolution
No. 10,771 on August 8, 1972; and
WHEREAS, the approved street system is in compliance with the
Redevelopment Plan for the project but requires additional financing
assistance by both the Federal Government and the City of National City;
and
WHEREAS, the City desires to further amend the Cooperation
Agreement with the Redevelopment Agency of the City of National City
in recognition of the currently estimated Financing Plan for the
redevelopment project.
Amendment No. 2
LOCAL GRANT-IN-AID AND COOPERATION AGREEMENT
THIS AMENDMENT, entered in this 15th day of August, 1972 by and
between the City of National City, a municipality of the State of
California (herein called the "Local Government") and the Redevelopment
Agency of the City of National City, a public body corporate and politic,
duly created and functioning under the laws of the State of California
(herein called the "Local Public Agency"), amends that certain Local
Grant -In -Aid and Cooperation Agreement executed between the parties on
January 28, 1970, and Amendment No. 1 thereto dated March 29, 1972.
(VITNESSETH: that
WHEREAS, the Local Public Agency in accordance with and pursuant
to Division 24, Part I, Health and Safety Code, State of California, is
undertaking a redevelopment project, known as the E. J. Christman Business
and Industrial Park I (herein called the "Project") located in that area
(herein called the "Redevelopment Area") of the City of National City,
County of San Diego, State of California; and
WHEREAS, the Project involves undertakings and activities by the
Local Public Agency in the Redevelopment Area for the elimination and for
the prevention of the development or spread of slums or blight and involves
slum clearances and redevelopment and rehabilitation and conservation, or
a combination or part thereof in accordance with a plan (herein called the
"Redevelopment Plan") adopted by the governing body of the Local Government
by Ordinance No. 1233 adopted the 18th day of November, 1969; and
WHEREAS, the Project area was enlarged and the official Redevelop-
ment Plan was amended by the governing body of the Local Government by
Ordinance No. 1303 adopted the 28th day of March, 1972; and
WHEREAS, upon the basis of reasonable estimates of cost prepared
by the Local Public Agency, it appears that the presently estimated costs
of the project are different from those estimated costs for the project
area which was in affect at the time of execution of the Local Grant -In -
Aid and Cooperation Agreement dated January 28, 1970, and of the Amendment
No. 1 dated March 29, 1972; and
WHEREAS, it is necessary and in the sound interest of the
community and otherwise beneficial and advantageous for the Local Government
to provide for the local grants-in-aid hereinafter specified and to other-
wise cooperate with the Local Public Agency in carrying out the Project to
the end that deleterious conditions in the Redevelopment Area be removed
and that the Redevelopment Area be renewed in accordance with sound
practical planning objectives, which renewal will result in increases of
tax revenues from the Redevelopment Area, decrease in expenditures and
contribute materially to the well being, progress and development of the
community as a whole:
NOW, THEREFORE, pursuant to the provisions of Section 33220 of
the California Health and Safety Code and in consideration of the benefits
to accrue to the Local Government, the community and the citizens thereof
from the Project, and of the covenants hereinafter set forth, the Local
Government and the Local Public Agency do agree and that certain Local
Grant -In -Aid and Cooperation. Agreement dated January 28, 1970 and Amended
March 29, 1972 is further amended as follows:
SECTION 1. The first WHEREAS clause on page 5 of the original
Agreement is changed to read as follows:

that the presently estimated net project cost of the
Project to be incurred -by the Local Public Agency in
carrying out the Project, constituting the difference
between the gross cost of the Project and the
proceeds derived from the disposition of the land
amounts to approximately Five ?•fiZZ.ion Nine Hundred
Eighty Thousand Seven Hundred Fifty Seven Dollars
($5,980,757) of which amount the Federal Government
is expected to provide an estimated amount too be
Four Million Four Hundred Eighty Five Thousand Five
Hundred Sixty Seven Dollars ($4,485,567) in the for',1
of a capital grant, leaving a balance of One Million
Four Hundred Ninety Five Thousand One Hundred Ninety
Dollars ($1,495,190) to be provided in the form of
local grants-in-aid; and °
SECTION 2. The TABLE OF CASH LOCAL GRANTS-IN-AID under item
(a) SEC. 1. on page 6 of the original Agreement is modified as follows:

(a) $75,000 in each of the fiscal years 1970-71,
1971-72,.1972-73 and 1973-74 or until such

cash flow requirements of the project are
provided from some other source.
(b) $50,000 by the end of December, 1972 and
an additional $50,000 by the end of December,
1973 or until such time as Tax Allocation
Bonds are sold or cash flow requirements of
the project are provided from some other
source.
4. Cash grant out of the proceeds from the sale of
Local Public Agency Tax Allocation Bonds

produced annually from redevelopment activities
in the project until each flow requirements of
the project are otherwise produced from some other

SECTION 3. The introductory phase of "Although there is no
amount set forth opposite Item 4 (cash grant out of proceeds from the sale
of tax allocation bonds" is deleted from Section 1.(a) (IV).
SECTION 4. The two dollar figures noted in SEC. 1.(b) are changed
from $544,400 and $544,400 to read $545,909 and $545;909 respectively.
SECTION 5. The table and schedules set forth in Section 10.
