HomeMy WebLinkAboutCC RESO 10,799RESOLUTION NO. 10,799 RESOLUTION DEFERRING REQUIREMENTS FOR INSTALLATION OF PERMANENT PAVING FOR ONE-HALF THE STREET WIDTH AT 1919 EAST 17TH STREET (Glenn E. Thomas) BE IT RESOLVED by the City Council of the City of National City that the application of Glenn E. Thomas for deferral of the installation of permanent paving for one-half the street width at 1919 East 17th Street is granted subject to the following conditions: 1. A covenant running with the land be obtained not to protest the application of the 1911 Improvement Act. 2. The property owner to bear the costs of improvements, whether initiated by the property owners or the City. PASSED AND ADOPTED this 5th day of September, 1972. Res. 10,799 COVENANT RUNNING WITH LAND This COVENANT is made by Glenn E. and Hilda R. Thomas, hereinafter referred to as "OWNERS." WHEREAS, Glenn E. and Hilda R. Thomas are the owners of that certain real property located in the City of National City, County of San Diego, State of California, described as follows: Southwesterly 75 feet of the Northeast Quarter of the Northeast Quarter of the West Half of 80 Acre Lot 1 in Quarter Section 128 of Rancho de la Nacion, according to Map 166 filed May 11, 1869, EXCEPTING the Northwesterly 165 feet; ALSO EXCEPTING therefrom the Southeasterly 30 feet. WHEREAS, said owners desire to be excused from the legal requirement to install permanent paving for one-half the street width at 1919 East 17th Street; NOW, THEREFORE, in consideration for the granting of a deferral to install said improvement by the City Council of the City of National City, said owners covenants for them - set V3S anc th��_ hcir= executors and administrators as follows: 1. The filing with the Planning Department of the City of National City of a covenant running with the land providing: a. The property owner will not protest the installation of any of the required improvements under a 1911 Improvement Act program whether initiated by the property owners or the City. b. The property owner will install said im- provements in conjunction with an overall improvement program of the area whether initiated by the property owner or the City.
