RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT
WITH GIRL'S CLUB OF NATIONAL CITY FOR USE OF
PROPERTY ADJACENT TO THE GIRL'S CLUB
BE IT RESOLVED by the City Council of the City of
National City that the Mayor and City Clerk are authorized
to execute and attest that certain lease agreement with the
Girl's Club of National City relating to the use of property
adjacent to the Girl's Club.

LEASE
This Lease, made and entered into this nineteenth
day of April, 1972, by and between the City of National City,
State of California, hereinafter designated as the "Lessor,"
and Girls' Club of National City, a non-profit corporation,
hereinafter designated as "Lessee,"
WITNESSETH:
THAT WHEREAS, said Lessee is desirous of leasing
from the Lessor certain real property for the purpose of
placing a clubhouse thereon and for promoting the physical,
mental and moral well-being of the girls of the City of
National City, and for girls in the immediate vicinity
thereof; and
WHEREAS, the use of said property for the purpose
aforementioned will promote the general welfare of all the
inhabitants of the City of National City; NOW THEREFORE,.
FOR AND IN CONSIDERATION OF SAID PREMISES, and in
further consideration of the covenants and agreements to be
performed by the parties hereto as hereinafter set forth,
the Lessor does by these presents lease, demise and let unto
the said Lessee the following described property situated in
the City of National City, County of San Diego, State of
California, to wit:
Lots 5 and 6 Block 4 of Subdivision of 10
acre lot 8 in quarter section of 154 of
Rancho De Nacion in National City according
to Map 552 filed San Diego County July 2,
1888.
For a term beginning with the date hereof and ending January
23, 2000, the rental to be One Dollar ($1.00) per year,
payable in advance annually.
In consideration of the covenants herein contained,
the parties hereto agree as follows:
I
That the above described premises are leased to said
Lessee by said Lessor for the purpose of maintaining a Girls
Club and to be used exclusively and for no other purpose than
to maintain said Girls Club and to promote the physical, mental
and moral well-being of the girls of the City of National City
and territory adjacent thereto and to provide such means of
education, wholesome recreation and proper guidance as may
seem most likely and desirable for the accomplishment of the
purposes herein set forth.

That this Lease shall not be assigned or transferred
nor shall said Lessee have the right to sub -let the leased premises
or any part thereof, without the consent in writing of the
City Council of said Lesor evidenced by a resolution thereof
duly adopted for said purpose.
III
That said Lessee shall bear the entire expenses arising
by reason of any improvements on said premises, and any improve-
ment shall conform with all the requirements of laws of the
State of California and the ordinances of the City of National
City, in connection therewith and in the operation and mainten-
ance thereof.
IV
The Lessor shall not be liable for the repair or upkeep
and/or maintenance of any improvementyto be located on said
premises as aforesaid.
V
Lessee agrees to make suitable provision, by ample
insurance coverage or otherwise, to save the City harmless
by reason of any negligent act or omission on the part of
said Lessee, its agents and employees, arising out of the

The lessor, by and through its proper officers,
reserves, and shall always have the right to enter said premises
for the purpose of viewing and ascertaining the conditions of
the same and the operation and maintenance thereof.
VII
That said Lessee, paying said rent and performing the
covenants and agreements contained herein, shall and may at all
times during said term peaceable and quietly have, hold and
enjoy the said premises for the term aforesaid, except as
hereinafter provided.
VIII
The premises hereby leased are to be used by the
Lessee as a Girls Club and for no other purpose, as aforesaid,
and it is further agreed between the parties that should the
Girls' Club of National City, California, Incorporated, cease
to exist, then, at the option of the Lessor, this Lease shall
be deemed cancelled and of no further force and effect, and
all liabilities of the parties hereunder shall cease. It is
agreed that notice by the Lessor to terminate this Lease as
herein provided shall be served upon the President or Secretary
of said Lessee, but if service cannot be made upon said officers
then service of such notice upon the Secretary of the State of
California shall be deemed sufficient notice.
IX
It is further agreed between the parties that at
the expiration of this Lease or any renewal thereof all build-
ings, structures, fixtures, improvements or parts thereof will,
at the option of the City, belong to said City and be left
affixed to said premises; provided however, that upon one
year's notice, prior to the expiration or termination hereof,
Lessee shall remove said buildings, structures, or other
improvements at its own expense.
X
No building, structure, improvement or fixture
shall be placed upon, constructed upon, or located upon
said premises without the prior consent of the City Council
of the City of National City.
IN WITNESS WHEREOF, this Agreement is executed by
the City of National City, pursuant to resolution authorizing
the Mayor to execute the same for and on behalf of said City,
and the Girls' Club of National City, a non-profit corporation,
has caused this instrument to be executed by its proper officers
thereunto duly authorized and its corporate name and seal to be
hereunto affixed the day and year in this Agreement first above
written.
