HomeMy WebLinkAboutCC RESO 10,461RESOLUTION NO. 10,461 RESOLUTION AUTHORIZING EXECUTION OF CONTRACTS BETWEEN THE CITY OF NATIONAL CITY AND THE NATIONAL CITY CHAMBER OF COMMERCE AND THE NATIONAL CITY JUNIOR CHAMBER OF COMMERCE BE IT RESOLVED by the City Council of the City of National City that the Mayor and City Clerk are author- ized to execute and attest those certain contract for pro- motion and advertising work between City of National City and the National City Chamber of Commerce and the National City Junior Chamber of Commerce. PASSED AND ADOPTED this 2lst day of September, 1971. ATTEST: CONTRACT BETWEEN CITY OF NATIONAL CITY AND NATIONAL CITY CHAMBER OF COMMERCE THIS AGREEMENT, made and entered into as of the -/ day of .J4,4 1971, by and between the City of National City, California, a municipal corporation, in the County of San Diego, State of California, hereinafter designated as City and National City Chamber of Commerce, an association, hereinafter designated as Advertiser. WITNESSETH: WHEREAS, Advertiser is the National City Chamber of Commerce which maintains full time offices at 711 A Avenue in the City of National City, California and which has special experience and facilities for promotion and advertising work to be done and performed for the City of National City; and WHEREAS, it is the desire of the City to employ said National City Chamber of Commerce as its agent for the purpose of advertising, exploiting, and making known the resources of the City for the purpose of inducing immigration to and increasing the trade and commerce of said City, and otherwise calling attention to its resources, its enterprises and its adaptability for industrial sites, all pursuant to the Government Code of the State of California; and WHEREAS, it has been found by said City that exhibits, brochures, freeway signs, a Salute to Navy Week as well as other special events and.ser- vices will promote the general welfare of said City and will publicize and advertise said City and will make known the enterprises of said City and will increase the trade and commerce of said City, and that as a result in years past, Advertiser has performed certain services for City for such purposes and has handled certain phases of the work necessary to conduct such activities and programs, and the City Council does further find and does hereby determine that the expenditure of the sum of $14,100.00 for the conducting of such activities and programs is proper for the purposes hereinabove set forth; NOW, THEREFORE, it is mutually agreed as follows: 1. THAT Advertiser shall use its facilities and its Epecial knowledge and experience in carrying out such activities and programs pursuant to their terms of this agreement and that the City hereby agrees to pay Advertiser the sum of $14,100.00 (Fourteen Thousand and One Hundred Dollars) subject to the terms, conditions and restrictions imposed by this agreement: 2. Advertiser covenants and agrees that it shall expend from the funds paid to it pursuant to this agreement not more than the sum of $ 4,850.00 for Salute to Navy Week 1,800.00 for Freeway Signs 2,450.00 for Christmas Decorations 1,000.00 for Exhibits and Displays 3,500.00 for City Information Services 500.00 for Miscellaneous City Advertising $14,100.00 TOTAL 3. City agrees to pay Advertiser said sum in ten monthly install- ments of up to $1,410.00 per month, all such sums paid to be substantiated by itemized statement of moneys actually spent or liabilities incurred by Advertiser pursuant to this contract. 4. That the term of this agreement shall expire on June 30, 1972: 5. That it is hereby mutually agreed that no part of any money paid by the City to Advertiser shall ever be used to pay any part of the salaries of its officers; 6. That on or before the first day of each month during the term of this agreement, beginning with September 1, 1971, Advertiser shall submit to the City a report giving details of out the purposes hereinabove set forth the steps taken by Advertiser to carry in this agreement, an evaluation of the results of such activities and programs and further setting forth bills itemized in detail showing the expenditures made and work done with the sums provided by City to Advertiser pursuant to this agreement; 7. It is distinctly understood and agreed that Advertiser shall not be entitled to receive any compc.nsation for its own services as such in conducting said program, and that the entire sum paid Advertiser by City pursuant to this agreement shall actually be paid out by Advertiser for de sole purpose of conducting the activities and programs hereinabove defined. IN WITNESS WHEREOF, slid City has caused this agreement to be executed by its Mayor and attested by its City Clerk and Advertiser has caused this agreement to be executed by its thereto duly authorized, the day and year in President and its Secretary this instrument first written. WITNESSETH: WHEREAS, The purpose of the National City Jaycee's, is to provide training in leadership for its members and for bettering their community. WHEREAS, The purpose of the Junior Miss Pageant is a National wide program to recognize, reward and encourage excel- lence in our young people. Each year since 1966 the National City Jaycee's has selected the Outstanding high school senior girl from among the msny who have taken part, from Sweetwater High School. Our Local winner advances to the State pageant which determines the candidate for the National Crown. The Junior Niss Pageant is not a Beauty Contest. Judging standards are High, pnd at all levels local, State, and National are based on 3cholastic ability, Poise, and Appearance, youth fitness, creative n..nd performing art, awareness, perception, ability in Human rela- tions and contrivution to family, community and church. WHEREAS, That as a result in years past, Jaycee's has performed certain services for city for such purposes and has handled certain phases of the work necessary to conduct such activ- ities and programs, and the City Council does further find and does hereby determine that the expenditure of the sum of $500.00 for the conducting of such activities and program for the purposes herein above set forth: (is proper). 1' NOW, THEREFORE, it is mutually agreed as follows: 1. That Jaycee's shall use its special knowledge and experience in carrying out such activities and programs by agrees to pay the Jaycees the sum of $500.00 (five hundred dollars) subject to the terms, conditions and restrictions imposed by this agreement: 2. Jaycee's convenant and agrees that it shall expend from the fund paid to it pursuant to this agreement not more than the sum of 500.00 Total. For the Jaycee's Junior Miss Pageant, to promote our youth in our community. And promote the general wel- fare of said city and will publicize and advertise National City: 3. City agrees to pay Jaycee's said sum in two in- stallments of $250.00 each. First one in September (the start of project) and $250.00 in November (the end of project). All such sums paid to be substantialed by itemized statement of moneys actually spent or liabilities incurred by Jaycee's pursuant to this contract. 4. That the term of this agreement shall expire on December 1st 1971. 5. That it is hereby mutually agreed that no part of any money paid by the City to Jaycee's shall ever be used to pay any part of the salaries of its officers: 6.
