RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO ORDINANCE NO. 962
(No. Z-88, West Avenue and National Avenue
between 16th and 18th Streets, Colonial Ford)
The .City Council of the City of National Citydoes
hereby find, determine, order and resolve as follows:
1. That practical difficulties, unnecessary hard-
ship, and a result inconsistent with the general purpose and
intent of Ordinance No. 962 would occur through 'strict appli-
cation of the provisions of said Ordinance to that certain
real property hereinafter described.
2. That a Petition requesting a blanket variance
has been filed pursuant to the provisions of Section 12.of Or-
dinance No. 962 and said Petition complies with all the re-
quirements of said section.
3. That the National City Planning Commission did
hold a hearing on said Petition and did recommend to the City
Council that a variance be granted.
4. That the granting of a variance with reference
to the 'property hereinafter described will not defeat, but
rather will carry out the general intent and purpose of the
National City Zoning Ordinance, will provide for the public
safety and welfare and will administer substantial justice.
5. That a variance from the provisions of said
Ordinance No. 962 be and hereby is granted with reference to
all the certain real property situated in the City of National
City, California, more particularly described as follows:
Lots 8 through 15 inclusive in Block 17; Lots 16
through 22 inclusive in Block 18; that portion of the
alley lying between said Lots 8 through 15 in Block
17 and also that portion of 17th Street lying between
said Blocks, said street and alley being vacated and
closed to public use in National City, in the City of
National City, in the County of San Diego, State of
California, according to Map thereof No. 348, filed
in the office of the County Recorder of said county.
Excepting from all of the above, those portions lying
Southwesterly of the Northeasterly line of West Avenue,
said Northeasterly line being described in deed to. the
City of National City, recorded October 20., 1926. as
Document No. 63950.of Deeds, said Northeasterly line
being described as follows:
Beginning at a Point in the Easterly line of said
Block 18, distant thereon North 19° West 98.88 feet
from the Southeasterly corner of Block 18: Thence
North 45° 34' West 168.96 feet to the Northerly line
of Block 18: Thence North 45° 34' West to the North-
erly line of said Block 17. (1700. National Avenue)
6. That the variance hereby granted is as follows:
Variance from five (5) foot setback upon a dedicated street
to zero (0) feet to permit utilization of an irregularly
shaped lot, located between West Avenue and National Avenue,
between 16th and 18th Streets, subject to the following
terms and conditions:
a. That the -property owner/applicant file
with the Planning Department an acknowledgment in writing,
stating that he agrees to remove existing A.C. surfacing
from parkways on National and WestAvenues, and on 1.6th
Street frontage, and landscape all adjoining street parkways
in compliance with a landscape plan approved by the Planning
Commission. All landscaping shall have an automatic irriga-
tion system. All landscaping shall be completed before is-
suance of a final occupancy permit and within 90.days.
b. All landscaping including street parkways
shall be continuously and adequately maintained by the owner/
applicant to the satisfaction of the Director of Parks and
Recreation.
c. Concrete wheel stops shall be installed
30" from the sidewalk on National Avenue frontage.
PASSED AND ADOPTED this 12thday of October, 1971.
