HomeMy WebLinkAboutCC RESO 10,517RESOLUTION NO. 10,517 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT TO PURCHASE PARCEL NO. 14190 (SEWER EASEMENT) FROM STATE OF CALIFORNIA DIVISION OF HIGHWAYS BE IT RESOLVED by the City Council of the City of National City that the City Manager of National City is hereby authorized and directed to execute an agreement with the State of California Division of Highways to purchase Parcel No. 14190 to be used as a connection between Ridgeway Drive and Euclid Avenue Extension for a sewer easement. PASSED AND ADOPTED this 7th day of December, 1971. ATTEST: SEWER EASEMENT Route 11-Sn.805 Parcel No. 14190 PROPOSAL I am interested in acquiring the parcel of excess State land adjacent to my property. This parcel'is identified on your right of way map as Parcel No. 14190 (Sewer Easement) . I hereby bid the sum of Twenty Five dollars ($ 25.00 ) as full payment for the purchase price of said excess parcel, and enclose a cashier's check,or certified check for this amount, payable to the order of the Division of Highways. I'further agree to deposit a check with the Division of Highways for payment of recording fees and Documentary Stamp Tax upon notification by said Division that the Director's Deed is ready for 'recording. I understand that this sale must be approved by the California Highway Commission. Upon acceptance by the Division of Highways of the amount bid, and the approval of the proposed sale by the California Highway Commission, the State of California shall issue a Director's Deed to the bidder or his assignee conveying the right, title and interest of the State of California in said real property. No assignment of the bidder's interest may be made after the execution of this contract and prior to receipt of a Director's Deed, and any such attempted or purported assignment shall be null and void as against the State of California, Division of Highways. • I understand that.I acquire no right, title or interest in said real property until the sale has been approved in the manner provided by law and • a Director's Deed has been executed, recorded, and delivered. Said Director's Deed will be processed in an expeditious manner by the Division of Highways. I understand that the right, title and interest in the property to be trans- ferred by this sale shall not exceed that vested in the State of California, and that no policy of title insurance will be furnished by the State in connection with this transaction. The fee title to the parcel of land is vested in the State of California free and clear of all encumbrances, except special assessments, if any, restrictions, reservations, and easements of! 'record. The property shall be conveyed by said Director's Deed to (Show how title is to be vested) I understand that the Division of Highways shall record said Director's Deed and that I may take possession.of said real property as soon as said Director's Deed has been filed for record by the State. Said State of California reserves the right to reject any or all bids and to cancel the sale at any time prior to recording of Deed. In the event of cancellation of sale, all moneys deposited shall be refunded without payment of interest.
