OF NATIONAL CITY REQUIRE THE CONSTRUCTION, OPERATION AND MAINTENANCE OF A PUBLIC STREET ACROSS CERTAIN DESCRIBED LAND IN THE CITY OF NATIONAL CITY., COUNTY. OF SAN DIEGO, STATE. OF CALIFORNIA, AND THAT THE PUBLIC INTEREST, CON- VENIENCE AND NECESSITY DEMAND THE ACQUISITION OF FEE TITLE TO SAID PROPERTY TO BE. USED BY SAID CITY FOR SAID PURPOSE; AND DECLARING THE INTENTION OF THE CITY OF NATIONAL CITY TO ACQIORE SAID PROPERTY. UNDER EMINENT DOMAIN PROCEEDINGS; COMMENCE AN ACTION IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA IN AND FOR THE COUNTY OF SAN DIEGO FOR THE PURPOSE OF ACQUIRING SAID PROPERTY ("I" Avenue Cul-de-Sac l6th Street South) BE IT RESOLVED by the Council of the City of National City as follows: SECTION 1: That the public interest, convenience and necessity of the City of National City and the inhabitants thereof require the construction, operation and maintenance of a public street across that certain parcel of real property located in the City of National City, County of San Diego, State of California, and fully described in Exhibit "A" here- to, which said Exhibit is attached hereto and by this ref- erence incorporated herein and made a part hereof as though set forth in full, SECTION 2: That the public interest, convenience, and necessity of said City and inhabitants hereof demand the acquisition and taking of feetitle to said property for the construction, operation and maintenance of the aforesaid public street lying within the City of National City, County of San Diego, State of California, SECTION 3: That the property to be condemned, is fully described in Exhibit "A" attached hereto and incorporated by reference in Section 1 above, SECTION 4: That the taking and acquiring by said City of the property described in Exhibit "A" hereto is deemed necessary for the construction, operation and maintenance of said public street by the City of National City and the in- habitants thereof for municipal purposes; that such uses are public uses and that for such public uses it is necessary that the City of National City condemn and acquire the property hereinabove described; that the property hereinabove described is to be used for the construction, operation and maintenance of the said public street. SECTION 5: That the City Attorney of the City. of National City be and he is hereby authorized and directed to commence an action in the Superior Court of the State of Calif- ornia in and for the County of San Diego, in the name and on behalf of the City of National City against all owners and claimants of the above described property rights for the purposes of condemning and acquiring said property rights for the use of said City. ATTEST: e CITY CLERK EXHIBIT "A" PARCEL 1 (Howard L. and Gertrude Morrisson): The Westerly 30 feet of the South 62.50 feet of the North 125.00 feet of the West 100.00 feet of the North Half of the East Half of the West Half of the South Half of 20 Acre Lot 1, Quarter Section 133 of Rancho de la Nacion in the City of National City, County of San Diego, State of California, according to the Map thereof No. 166 by Morrill filed in the office of the County Recorder of said San Diego County on May 11, 1869. PARCEL 2 (Christensen Construction Corporation): That portion of the Westerly Half of the Westerly Half of the Southerly Half of 20 Acre Lot 1, Quarter Section 133, Rancho de la Nacion, according to the Map thereof No. 166 by Morrill, filed in the office of the County Recorder of said San Diego County, May 11, 1869, described as follows: Commencing at the Southeasterly corner of said Westerly Half of the Westerly Half; thence Northerly along the Easterly line of said Westerly Half of the Westerly Half a distance of 205 feet to the Northwesterly corner of that parcel of land conveyed to Acel M. Bushert and Annie E. Bushert by deed recorded September 10, 1947, in book 2487 at Page 224 of Official Records of said County; thence continuing Northerly along said Easterly line 35 feet to the center of a 35 foot radius circular curve hereinafter described, being also the TRUE POINT OF BEGIN- NING; thence continuing Northerly along said Easterly line 2 feet to the Northeasterly corner of that parcel of land conveyed to Christensen Construction Corporation, a Calif- ornia Corporation, by deed recorded December 29, 1967, at File/Page 205074, Series 8, Book 1967, of Official Records of said County; thence Westerly along the Northerly line of said Christensen land 34.94 feet, more or less to its inter- section with the arc of the aforementioned 35 foot radius circular curve; thence Southerly and Easterly along the arc of said 35 foot radius circular curve through a central angle of 93°16'33", more or less, to its intersection with the Easterly line of said Westerly Half of the Westerly Half at the said Northwesterly corner of Bushert land; thence Northerly along said Easterly line 35 feet to the TRUE POINT OF BEGINNING. Bushert by deed recorded September 10, 1947, in Book 2487 at Page 224 of Official Records of said County; thence continuing Northerly along said Easterly line 35 feet to the center of a 35 foot radius circular curve here- inafter described; thence continuing Northerly along said Easterly line 2 feet to the Northeasterly corner of that par- cel of land conveyed to Christensen Construction Corporation, a California Corporation, by deed recorded December 29, 1967 at File/Page 205074, Series 8, Book 1967 of Official Records of said County, being also the TRUE POINT OF BEGINNING; thence Westerly along the Northerly line of said Christensen land 34.94 feet, more or less, to its intersection with the arc of the aforementioned 35 foot radius circular curve; thence Northerly and Easterly along the arc of said 35 foot radius circular curve through a central angle of 23° 59' 27", more or less, to the beginning of a tan- gent reverse curve, concave Northwesterly, having a radius of 10 feet; thence Northerly and Westerly along the arc of said 10 foot radius curve through a central angle of 27° 16' a distance of 4.76 feet to the point of tangency with the Westerly line of the Easterly 30 feet of said West Half of the West Half; thence Northerly tangent to said 10 foot radius curve, along said Westerly line 25.38 feet more or less to the Northerly line of said Southerly 44.00 feet of the Northerly 88.00 feet; thence Easterly along said Northerly line 30 feet to the Easterly line of said West Half of the West Half; thence Southerly along said Easterly line 44.00 feet to the TRUE POINT OF BEGINNING.
