RESOLUTION AUTHORIZING STIPULATED JUDGMENT IN ACTION
TO CONDEMN REAL PROPERTY FOR STREET PURPOSES--LUHNOW
WHEREAS, the City of National City has heretofore
instituted Superior Court action No. 317529 to condemn private
property for street purposes, and
WHEREAS, the appraisal to the City Council that
the fair market value of the land and land rights being taken
is $10,000.00, and
WHEREAS, the City and the land owners desire to
spare the expenses of future litigation;
NOW, THEREFORE, BE IT RESOLVED that the City Attorney
is authorized and directed to stipulate to a judgment in the
above entitled action awarding the amount of $10,000 as full
just compensation for the condemnation of the land and land
ights in question. The City Attorney is authorized and
directed to further stipulate that the condemnation in ques-
tion does not result in "lot split" or "subdivision" as the
same terms are used in various City and State laws. The
City Attorney is further authorized to stipulate that the
two parcels of real property remaining in the ownership of
the defendant are not legal building sites, under existing
law. The City Attorney is further authorized and directed
to stipulate that the structure now existing on the defend-
ant's remaining real property will not become "non -conforming
use" by virtue of its proximity to existing or future property
lines resulting from the condemnation above described.
BE IT FURTHER RESOLVED that the Finance Director
is authorized and directed to pay the above stiuplated judg-
ment in the amount of $10,000.00.

1971.
