RESOLUTION ACCEPTING COVENANT RUNNING WITH LAND AND
DIRECTING THE RECORDING THEREOF
(Miles L. and Velva Juanita Peio)
BE IT RESOLVED by the City Council of the City
of National City that a Covenant granted to the City of
National City by MILES L. and VELVA JUANITA PEIO affecting
property at 1417 Palm Avenue - Vacant Lot on "Q" Avenue,
National City, is hereby accepted and the City Clerk is
directed to record the same.
PASSED AND ADOPTED this 25th day of May, 1971.

COVENANT RUNNING WITH LAND
THIS COVENANT is made by MILES L. and VELVA
JUANITA PEIO, husband and wife as joint tenants, hereinafter
referred to as "OWNERS".
WHEREAS, MILES L. and VELVA JUANITA PEIO are the
owners of that certain real property located in the City of
National City, County of San Diego, State of California,
described as follows:
The Westerly 155.00 feet of the Southerly 65.00
of the Northerly 213.00 feet of the West Half of the
South Half of the West Half of the Southwest Quarter
of Quarter Section 129, RANCHO DE LA NACION, in the City
of National City, County of San Diego, State of Calif-
ornia, according to Map thereof No. 166, by Morrill on
file in the Recorder's Office of San Diego County.-
Excepting therefrom the Westerly 30.00 feet.
WHEREAS, said owners desire to be excused from the
legal requirement to install curbs, sidewalks and paving along
street frontage at 1417 Palm Avenue - Vacant Lot on "Q" Avenue
until an improvement project is formed for the entire street
and/or area;
NOW, THEREFORE, in consideration for the granting
of a waiver to install said improvements by the City Council
of the City of National City, said owners covenant for them-
selves and their heirs, successors, assigns, executors and
administrators as follows:
1. Said Owners will not protest the installation
of any of the required improvements under a 1911 Improvement
Act program whether initiated by the property owners, City
of National City, or County of San Diego, and
2. That a topographic map and grading plan for
these lots first be submitted to the City Engineer for his
approval.
3 That the applicant first pay sanitary sewer
connection fees as determined by the Department of Building
and Housing.
Said Covenant shall run with and be a burden
on the within described real property.

sworn, personally appeared DONE MINOGUE known to me to be the person
whose name is subscribed to the within instrument as a Witness thereto,
who being by me duly sworn, deposes and says.: that she resides in
National City, San Diego County, and that she was present and saw
Miles L. Peio and Velva Juanita Peio, personally known to her to be
the same persons whose names are subscribed to the within and annexed
Instrument, execute and deliver the same and she acknowledged to said
affiant that they executed the same; and that said affiant subscribed
her name as witness.
