BE IT RESOLVED by the City Council of the City of National City, California as follows: That the Mdayor and City Clerk are authorized and directed to execute and attest that certain Grant of Easement whereby the City of National City grants to SAN DIEGO GAS & ELECTRIC COMPANY the property more fully described in said Grant of Easement, a copy of which is attached hereto and is hereby incorporated by reference. PASSED AND ADOPTED this loth day of August, 1971. ATTEST: 4„ CITY CLERK EASEMENT CITY OF NATIONAL CITY, a municipal corporation hereinafter called "Grantor", for valuable consideration, grant(s) to San Diego Gas & Electric Company, a corporation, hereinafter called "Grantee", an easement upon, over, under and across the lands hereinafter described, to erect, construct, reconstruct, replace, repair, maintain and use, a line of poles with wires suspended thereon and all necessary and proper guys, anchorage, crossarms, braces and other fixtures for use in connection therewith, at such locations and elevations upon, along and over the hereinafter described easement as Grantee may now or hereafter deem convenient and necessary at any time and from time to time, for the trans- mission and distribution of electricity for all purposes for which it may be used, together with the right of ingress thereto and egress therefrom, to and along said line, over and across the Grantor's land situate in the County of State of California, and more particularly described as follows: San Diego That portion of the West Half of Lot.1 in Quarter Section 130 of Rancho de la Nacion, according to Map thereof No. 166, filed in the office of the County Recorder of said County of San Diego; described in a Deed recorded in Book 3780, page 217 of Official Records of said County of San Diego, excepting therefrom those portions described in Deeds recorded in Book 3795, page 292, recorded in Book 4017, page 161, recorded in Book 4213, page 472, recorded February 13, 1962 at Recorder's File/Page No. 24766, recorded August 30, 1963 at Recorder's File/Page No. 155565, recorded July 14, 1964 at Recorder's File/Page No. 126711 and recorded February 2, 1970 at Recorder's File/Page.No. 18277, all of said Official Records. The said easement in the aforesaid lands shall be 4.00 feet in width, being 2.00 feet measured at right angles on each side of the following described center line: PARCEL 1: Commencing at the Northeast corner of the West Half of 80 Acre Lot No. 2 of said Quarter Section 130, Rancho de la Nacion, said Northeast corner bears North 71° 58' 50" East from the Northwest corner thereof; thence from said Northeast corner South 86° 48' 39" West, 354.56 feet to the TRUE POINT OF BEGINNING of the center line herein described in Parcel 1; thence from said TRUE POINT OF BEGINNING North 48° 46' 48" West, 220.30 feet; thence North 46° 35' 20" West, 210.00 feet. ALSO: Beginning at the TRUE POINT OF BEGINNING of said Parcel 1; thence South 45° 20' 18" East, 143.14 feet. ALSO: Beginning at the TRUE POINT OF BEGINNING of said Parcel 1; thence Ncrth 42° 53' 27" East, 25.00 feet. DATE _7_?2_71 A}ori4c �;..� —2— Grantor grants to Grantee the right, easement and privilege of placing, erecting and maintaining on the above described lands of the Grantor adjacent to the above described easement such anchorage as may be necessary at any time and from time to time to properly guy the line(s) of poles constructed upon said easement. Grantor shall not dig or drill any well, plant any tree, erect, place or construct any building or other structure, within the boundaries of the above described easement. Grantee shall have the right, but not the duty, to trim and/or remove trees and/or brush along or adjacent to said easement whenever Grantee deems it necessary, said right shall not relieve Grantor of the duty as owner to trim and/or remove trees and brush to prevent danger or hazard to property or persons. The terms, covenants and condtions of this easement and right of way shall be binding upon and inure to the benefit of any heirs, executors, adminis- trators, permittees, licensees, agents or assigns of Grantor and the successors and assigns of..Grantee.
