RESOLUTION ACCEPTING COVENANT RUNNING WITH
THE LAND AND DIRECTING THE RECORDING THEREOF
(Villarin and Kercher)
BE IT RESOLVED by the City. Council of the City of
National City that a Covenant granted to the City of National
City by Patsy A. and Lanny R. Villarin affecting property on
Orange Avenue adjacent to 2240 E. 16th Street and Howard
Kercher affecting property at 105 "L" Avenue, is hereby ac-
cepted and the City Clerk is directed to record the same.
PASSED AND ADOPTED this'17'th day of August, 1971.

COVENANT RUNNING WITH LAND
THIS COVENANT is made by LANNY R. and PATSY A.
VILLARIN, husband and wife as joint tenants, hereinafter
referred to as "OWNERS".
WHEREAS, LANNY R. and PATSY A. VILLARIN are the
owners of that certain real property located in the City of
National City, County of San Diego, State of California, des -
Bribed as follows:
Lot H in Block 5 of Lincoln Acres Orchard Sub -
•division of National City, according to map thereof
Number 1785 filed in the Office of the County Recorder
of San Diego County, except the Southerly 20 feet being
measured along the Westerly line of said Lot.
WHEREAS, said owners desire to be excused from the
legal requirement to install permanent paving for one-half
the street width on that portion of Orange Avenue adjacent to
2240 E. 16th Street until portion to be paved conforms to the
existing grade;
NOW, THEREFORE, in consideration for the granting
of a deferral to install said improvements by the City Council
of the City of National City, said owners covenant for them-
selves and their heirs, successors, assigns, executors and
administrators as follows: -
1. Curbs, gutters and sidewalks shall be•installed
in accordance with City of National City Engineering specifica-
tions.
2. The property owner shall file with the Planning
Department of the City of National City a Covenant Running
With the Ldand, providing:
a. He will not protest the installation of
said public improvement under a 1911 Improvement Act prgram,
whehter initi?ted by the property owners or the City; and
b. He will install said improvement in con-
junction with an overall improvers nt program of the area,
whether initiated by the property owners or the City;.
3. Resolution No. 10,296, Resolution Waiving Re-
quirements for Installation of Curbs, Gutters, Sidewalks and
Half -street Improvements for a period of one year, be amended
to defer paving requirements and to incorporate provisions of
condition 2, as hereinabove set forth; and
4. Prior to City Council of amended resolution,
said covenant shall be a matter of record.

certain real property located in the
City of National City, County of San Diego, State of California, described as follows:
The Northerly 80 feet of Lot 11, Block 2, PARAOENA PARK, County of San
Diego, State of California, according to the Map thereof No. 1404, filed in
-the office of the Recorder of said San Diego County.
WHEREAS, said Owner desires a waiver of the requirement of installing full street
improvements along the public streets upon which the real property fronts;
Ir rLiRG, in consideration for the granting of a waiver to install said im-
provements said Owner covenants for himself and his heirs, successors, assigns, executors,
and administrators as follows:
1. Said Owner will not protest the installation of any of the required
improvements under a 1911 Improvement Act program whether initiated by the
property owners of -the City, and
2. Said Owner will install said improvements in conjunction with an
overall program of the area whether initiated by the property owners or the
City.
SAID COVENANT SHALL RUN WITH AND BE A BINDER ON THE WITHIN DESCRIBED REAL PROPERTY.
