HomeMy WebLinkAboutCC RESO 10,439RESOLUTION NO. 10",43.9 RESOLUTION PERM TIPU SUANTITONORDINANCETIAL NED EVELOPMENT 1077 (McMillin Construction Company) The City Council of the City of National City, California, does hereby find,determine, order and resolve as follows: 1. At a regular meeting of the City Planning Com- mission on August 9, 1971, said a recommendation that the owner being between Fifth and Seventh Streets and between "T" and "V" Avenues, and more fully described in Exhibit "A" attached hereto and made a part hereof as though set forth in full, be granted a Residential Planned Development Permit upon the conditions hereinafter stated. 2. That the City Council has received the recom- mendation of the Planning Commission, and after full and complete consideration of said recommendation hereby grants a Residential Planned Development Permit to construct apartment houses subject to the following terms and conditions: a. Prior to the issuance of a building permit by the Department of Building and Housing, the property owner shall file with the Planning Department an acknowledgment in writing, stating -that he is cognizant of all conditions as hereinbelow set forth and agrees to perform all work within a period of time not to exceed one (1) year from date of issuance of a building permit. b. Off-street parking shall be provided at a minimum ratio of 1.5 (8' x 18') spaces per dwelling unit. (1) Each parking site shall be level in grade, surfaced with a minimum of two (2) inches asphalt paving or equivalent, clearly marked and provided with wheel stops. c. The perimeter of all access drives and areas, exclusing those areas of public right-of-way, parking Commission unanimously adopted of the real property known as shall incorporate either a concrete or "dike -mix" curb. d. All buildings shall be: constructed simul- taneously, with all units receiving certificates of occupancy prior to occupancy of any unit. e. Utility connections shall not be authorized until all conditions of this permit have been satisfied. f. Landscaping shall be installed and maintained as shown on the submitted landscape plan, approved as corrected by the Director of Parks and Recreation, August 3, 1971. (1) Corrections to Landscape Plan: (a) Canary Island Pines in place of Monterey Pines at Building 6 and Building 7. (b.) Podocarpus Maki or Macrophylla instead of Elongata at Building 6. All trees, shrubs, and plants shall be clear g• of insect pests or fungus disease or the effects of previous infestations. h. All areas within the development not surfaced for walkways, parking, recreational use or covered by buildings shall be .landscaped. Landscaping shall include shrubs, trees, ground cover, lawn, decorative rock or attractive paved sur- faces, earth features and rock groupings. i. Large trees and shrubs shall be adequately supported when planted. Such supports shallbe so designed that the trees and shrubs will not be injured. j. All trees, shrubs, and plants shall be periodically fertilized, weeded, aerated, trimmed, edged, and watered and shall be maintained in a healthy, growing Condition. k. All trees, shrubs, and plants which have been planted and which, due to accident, damage, disease or other cause, fail to show a healthy growth shall be replaced. 1. All plant growth shall be controlled by pruning, trimming, or otherwise so that it will not: (1) Interfere with installation, mainten- ance, and repair of any public utility. (2.) Restrict pedestrian or vehicular access. (3) Constitute a traffic hazard. m. All areas of landscape shall be provided with a permanent underground automatic sprinkler irrigation or other acceptable watering system. Said system shall be capable of providing a proper amount of precipitation for the particular type of plant materials used. n. All electrical, telephone, or similar dis- tribution utility facilities shall be placed underground in accordance with undergrounding provisions of the zoning code. o. Development shall be in accordance with development plans on file in the Planning Department. p. Swimming pool shall be completely enclosed within a six-foot (6') fence. q. Property owner shall work with the San Diego Gas and Electric Company on the installation of street lights of an ornamental design. r. The twenty-four foot (24') drive shall be designated as a fire land. Said drive shall be posted "No Parking." s Two (2) private fire hydrants shall be installed in accordance with the Fire Chief's recommendation. t. Stop signs shall be installed at each exit point of the 24' drive. (5th and 7th Streets) u. The City of National City shall pay one-half or $770.00, whichever is least, toward the cost of the "K" curb drain inlet and the cost of the 40 feet of 18" R.C.P. v. One-half of the street on the 7th and 5th Streets shall be fully improve, including sidewalks adjacent to said property. The City shall install a temporary surface of approximately 2" of asphalt from this development to "T" Avenue when curbs and gutters are all in on 7th Street. .. w. All recreational facilities, i.e., basket- ball court, four square court, tetherball court, sandbox, slides, jungle gym, concrete pipe tunnels, picnic tables, etc., shall be installed prior to occupancy of any unit.
