HomeMy WebLinkAboutCC RESO 10,440RESOLUTION NO. 10,440 RE.SOLUT.ION GRANTING A CONDITIONAL USE PERMIT (3200 National Avenue- Moynahan) The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. At a regular meeting of the City Planning Com- mission on August 9, 1971, said Commission unanimously adopted a recommendation that the real property located at 3200 National Avenue, be granted a Conditional Use Permit upon the conditions hereinafter stated. 2. That the City Council has received the recom- mendation of the Planning Commission, and after full and com- plete consideration of said recommendation hereby grants a Conditional Use Permit to allow for autotowing, storage and repair at 3200 National Avenue subject to the following terms and conditions: a. Prior to the issuance of a Building Permit by the Department of Building and Housing, the property owner shall file with the Planning Department an acknowledgement in writing, stating that he is cognizant of all conditions as hereinbelow set forth and agrees to satisfy said conditions within a period of time not exceeding 180 days from date of issuance of the first building permit for any part of this work. b. Utility connections shall be authorized only after all conditions of this permit have been satisfied. c. All operations and storage, including all equipment used in conducting said use, other than parking, shall be conducted within an enclosed building or within an area enclosed by a solid wall or solid fence. d. The entire premises for which this permit is granted shall be enclosed by fences, or building, or com- bination thereof. (1.) All fences and walls shall be of a uniform height in relation to the ground upon which they stand. Where fences or walls are located adjacent to a dedicated street, they shall be set back at least four feet (4.') from the lot line. (2) All fences and walls open to view from any street or highway shall be constructed of the following materials: (a.) Metallic panels, at least .024. inches thick, painted with a "baked on" enamel or similar permanent finish. (b) Masonry. (c) Other materials comparable to the foregoing if approved by the Planning Commission. (3) All fences and walls shall be con- structed in workmanlike manner and shall consist solely of new materials unless the Director of Planning approves the substitution of used materials where, in his opinion, such used materials will provide the equivalent in service, appear- ance, and useful life. (4) All fences and walls shall be maintained in a neat, orderly condition at all times. Such fences or walls shall contain no painted signs or posters except as approved by the Director of Planning. (5) Any structures which are used as part of the yard boundaries and/or are exposed to view from a street or highway frontage shall be subject to painting, maintenance and sign requirements for fences and walls as hereinabove pro- vided. The Director of Planning may approve other appropriate architectural treatment. e. All areas of the yard open tovehicular passage shall be paved with not less than two inches (2") thick asphalt surfacing or oil and aggregate mixture to prevent emission of dust or tracking of mud onto public rights -of -way, provided, however, the Director of Planning may approve other paving materials which provide, in his opinion, the equivalent in service and useful life. f. Off -Street parking shall be provided at a minimum of one (1) space for each two employees on the maximum working shift plus one (1) space for each 800 square feet of gross floor area. (1) Each required parking space shall be not less than nine feet (9°) in width and twenty feet (20') in length, exclusive of all other areas. (2) Each required parking space shall open directly upon an aisle or driveway of such width and design as to provide safe and sufficient means of vehicular access to such aprking sapce. (3) The parking sites required shall not be used for parking of vehicles used directly in the conducting of this use. g. The required four foot (4') setback from property line shall be landscaped and maintained in accordance with the following criteria: (1) Landscaping shall be provided in accord- ance with a plot plan prepared by the applicant herein and ap- proved by the Director of Planning. (2) A permanent irrigation system which satisfactorily irrigates all planted areas shall be provided. (3) All landscaped areas shall be contin- uously and properly maintained in good condition. h. A list of requirements will be submitted to the owner/operator, by the Fire Chief, National City Fire Department. All such requirements shall be continuously complied with. i. The entire site shall be continuously main- tained to prevent accumulation of weeds, rubbish, litter or combustible waste. Any incidents of rat or vermin harborage shall be promptly corrected. j. Curb, gutter and sidewalk adjacent to the subject site on National Avenue frontage shall be installed. k. Access rights adjacent to future freeway construction shall be relinquished. (The southerly 180.feet of the easterly boundary, and the entire southerly boundary of said parcel.) 1. The proposed "earth open channel" shall have a section meeting the following specifications: (1) Two foot (2.') bottom. (2) Two horizontal to one vertical slopes to a height of four feet (4') with rip -rap on bottom and on slopes. (3) A four foot (4') in width planted terrace on the southwesterly and the northeasterly sides. (4) The remaining slope to the top of the proposed fill to be two horizontal to nne vertical planted slopes. m. Upon finding that any of these conditions are not being substantially complied with, the City Council may, in the manner described in the zoning code, order the modification of said conditions or the revocation of this permit.
