RESOLUTION GRPNTING .ZONE. VARIANCE PURSUANT ;TO ORDINANCE NO. 962
(No. Z-81, Division of Land into Two
Parcels at 2005 Lanoitan Avenue)
The City Council of the City of National City does
hereby find, determine, order and resolveas follows:
1. That practical difficulties, unnecessary hard-
ship, and a result inconsistent with the general purpose and
intent of Ordinance No. 962 would occur through strict appli-
cation of the provisions of said Ordinance to that certain
real property hereinafter described.
2. That a Petition requesting a blanketvariance
has been filed pursuant to the provisions of Section 12.of Or-
dinance No. 962 and said Petition complies with all the re-
quirements of said section.
3. That the National City Planning Commission did
hold a hearing on said Petition and did recommend to the City
Council that a variance be granted.
4. That the granting of a. variance withreference
to the property hereinafter described will not defeat, but
rather will carry out the general intent and purpose of the
National City Zoning Ordinance, will provide for the public
safety and welfare and will administer substantial justice.
5. That a variance from the provisions of said
Ordinance No. 962 be and hereby is granted withreference to
all the certain real property situated in the City of National
City, California, more particularly described as follows:
The westerly 150 feet of lot 27.2 of Lincoln
Acres Annexation No. 2 in the City of National
City, according to map thereof No. 1748, filed.
in the office of the County Recorder February
7, 1923 (2005 Lanoitan).
6. That the variance hereby granted is as follows.:
Division of a parcel of land containing 9,900.square feet into
two parcels with variance in square footage in one lot from
5,000.square feet to 4,900 square feet subject to the follow-
ing conditions:
a. The existing single family dwelling con-
demned by the Department of Building and Housing shall be
razed within a period of time not to exceed thirty (30)
days of City Council approval of resolution granting variance.
b. Construction of new duplex structure shall be
commenced within a period of time not toexceed sixty (60)
days from date of adoption of said resolution by the City
Council with completion within a period of time not to ex-
ceed one (1) year of the date of issuance of the building
permit.
c. A Certificate. of Occupancy shall be obtained
from the Director of Building and Housing within said speci-
fied period of time for completion.
d. Construction shall be pursuant to all provisions
of the Zoning Ordinance except for the following:
(l) Off-street parking shall be 'provided at a
ratio of not less than one and one-half (1:-1/21 spaces per
dwelling unit.
(2) Off-street parking sites shall be a mini-
-mum nine (9) feet in width by twenty (2.0)'feet in
length.
e. Construction and improvements shall comply with
all laws, codes and ordinances of the City of National City.
7. In the event that the City Council should here-
after find and determine that the conditions above set .forth
have not been satisfied, it may declare this variance void
and of no further effect.
