HomeMy WebLinkAboutCC RESO 10,036RESOLUTION NO. 10,036 RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO ORDINANCE NO. 962 (Zone Variance No. Z-68, Expanding Existing Warehouse, 706 "A" Avenue) The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That practical difficulites, unnecessary hard- ship, and a result inconsistent with the general purpose and intent of Ordinance No. 962 would occur through strict appli- cation of the provisions of said Ordinance to that certain real property hereinafter described. 2. That a Petition requesting variance has been filed prusuant to the provisions of Section 12 of said Ordin- ance and said Petition complies with all the requirements of said section. 3. That the National City Planning Commission did hold a hearing on said petition and did recommend to the City Council that a variance be granted. 4. That the granting of a variance with reference to the property hereinafter described will not defeat, but rather will carry out the general intent and purpose of the National City Zoning Ordinance, will provide for the public safety and welfare and will administer substantial justice. 5. That a variance fromthe provisions of said Ordinance No. 962 be and hereby is granted with reference to all the certain real property situated in the City of National City, California, more particularly described as follows: Lot No. 9 and southerly 3 feet more or less of Lot No. 10 Block No. 1 of T. Parson's addition to National City (property abutting 706 "A" Avenue on the west side). 6. That the variance hereby granted is as follows: Variance from the provisions of the Zoning Ordinance No. 962 of the City of National City to permit the expansion of existing warehouse due to increase in food handling business at 706 "A" Avenue, National City, California. Variance granted is subject to the following conditions and/or restrictions: a. Proposed addition shall be in architectural harmony with the existing building as shown on the submitted plans. b. A minimum of six (6) off-street parking sites 9' x 20' shall be installed and permanently maintained. c. All parking spaces and driveways shall be surfaced with asphaltic concrete at least two (2) inches in depth, or its equ.ibalent, and spaces lined. d. Adequate ingress and egress to loading and unloading dock shall be permanently maintained. e. Direct loading and unloading from a public street is prohibited. f. Outdoor storage of merchandise, materials, equipment or other goods shall be prohibited. g. Processing of fresh food shall be prohibited. h. All vehicles operating from this business shall be parked off-street during non -working hours. i. Unused driveways on "A" Avenue shall be restored to curb and sidewalk. j. Two (2) trees (type and size to be determined by the Director of Parks and Recreation) to be installed on "A" Avenue in existing cuts. k. All utilities to be placed underground. 1. The development shall be installed and completed as per the plans submitted to the Planning Department with the application for variance. m. In the event that the City Council upon re- commendation of the Planning Commission should hereafter find and determine that the conditions above set forth have not been satisfied, it may declare this variance void and of no further effect.
