HomeMy WebLinkAboutCC RESO 10,153RESOLUTION NO. 10,153 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH CITY OF SAN DIEGO FOR IMPROVEMENT OF CERVANTES AVENUE BE IT RESOLVED by the City Council of the City of National City that the City Manager of National City is hereby authorized and directed to execute an agreement with CITY OF SAN DIEGO for improvement of Cervantes Avenue. PASSED AND ADOPTED this 4th day of imgust, b70. ATTEST: AGREEMENT THIS AGREEMENT is made by the CITY OF SAN DIEGO, a municipal corporation, herein called "San Diego", and the CITY OF NATIONAL CITY, a municipal corporation herein called "National City". RECITALS A. San Diego and National City desire to improve Cervantes Avenue from Euclid Avenue, easterly to Paradise Road, herein called "Project", in order to provide better circulation of traffic in the area. B. San Diego and National City desire to proceed with construction of the Project and to share in the costs thereof. C. San Diego will administer the Project proceedings, to be undertaken pursuant to the California Improvement Act of 1911 commencing with Section 5000 Streets and Highways Code. D. National City desires to contribute towards the cost of the Project in lieu of assessments against lands within National City. NOW, THEREFORE, in consideration of the recitals and the mutual obligations of the parties as herein expressed, San Diego and National City agree as follows: 1.. San Diego shall cause Project to be improved by widening to a forty (40) foot width in accordance with San Diego Standards for such streets. 2. That the distribution of the work and responsibility therefor is, but not limited tq the following: a. That San Diego will design and prepare plans and specifications for the entire project. b. Plans for the Project shall be approved by both the City Engineer of San Diego and the City Engineer of National City. c. San Diego will provide all inspection and contract management service. d. National City will issue a permit to San Diego to cover work being done within the jurisdiction of National City. 3. In the event additional right-of-way must be obtained, it will be the responsibility of the agency in whose jurisdiction the property is located to acquire the necessary right-of-way within its jurisdiction. 4. (a) National City shall pay San Diego its share of Project costs which shall be computed on the basis of the actual construction costs plus a fixed percent (16`/) of such construction costs as an allowance for design, field engineering, and contract management services. Exhibit A, (Engineering Drawing No. 13219-1 to 7-D), and Exhibit B, (List of Quantities and Estimate) attached hereto, shall be used in the computation of National City's contribution to- ward the actual construction costs. Field changes, if necessary during construc- tion shall be submitted to National City for approval. (b) After bids for construction have been opened by San Diego, a revised contribution estimate will be computed by San Diego and submitted to National City for approval. Upon approval of such estimate, National City shall deposit with San Diego its estimated contribution. Only after such deposit by National City shall San Diego award the contract and begin construction. After all work has been completed and final construction costs have been determined together with the fixed percentage allowance for field engineering and contract management services, San Diego shall return any excess deposit to National City. If National City's share is more than the amount deposited, National City shall pay San Diego the difference, upon the receipt of a bill from San Diego to National City. IN WITNESS WHEREOF, this AGREEMENT is executed by the City of San Diego, acting by and through its City Manager, pursuant to Resolution No. authorizing such execution, and by the City of National City acting by and through its City Manager, pursuant to Resolution No. authorizing such execution, this day of , 1970.
