HomeMy WebLinkAboutCC RESO 10,167RESOLUTION NO. 10 167 RESOLUTION GRANTING COMMERCIAL PLANNED DEVELOPMENT PERMIT PURSUANT TO ORDINANCE NO. l0/7 (Fed -Mart) The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. At a regular meeting of the City Planning Com- mission on June 26, 170 after a public hearing duly held and noticed, said Commission unanimously adopted a recom- mendation that the owners of the real property more fully des- cribed in Exhibit A attached hereto and incorporated by ref- erence, be granted a Commercial Planned Development Permit upon the conditions hereinafter stated: 2. That the City Council has received the recommen- dation of the PlanninP. Cornmission, and after full and complete consideration of said recommendation hereby grants a Commercial Planned Development Permit upon the following terms and condi- tions: a. Al' construction shall be in accordance with the revised plans on file in the Planning Department. Landscaping shall be in accordance with the original plans attached to the applicant's application. b. Construction shall commence within ninety days after the date of the resolution adopted by the City Council approving a Limited Commercial Planned Development Permit, and be compietec in its entirety within a period of time not to exceed eighteen (1C) months from said date of approval. c. The sequence of construction shall be in two phases. Phase One shall include the construction the Fed - Mart Store Building and the Tire, Battery Accessory Building; the Gasoline Pump Island and Car Wash Building. Phase Two wi_i consist of development of tenant space. 6. That area allocated for future tenant space at the southerly end of the main building may be temporarily utilized for actitional off-street paring provided, nowever, that said area shall be striped and only utilized for parking until such time as a building is erected on the site. e. The main building " d-Mart Store) shall incorp- orate an exterior surface of 'Tan Slump Stone Block"' and a man- sard extension over the entrance with an exterior finish of burnt orange baked enamel. All other buildings and/or structures to be constructed shall incorporate an exterior finish architec- turally compatible with that of the main building. Adequate provisions for the enclosure of rubbish containers shall be provided. f. All buildings and/or structures to be constructec in Phase Two shall be located in accordance with the plans attached. to the applicant's application, (Planned Development Permit No. 26) and shall be subect to the approval of plans by the Planning Commission when in the opinion of the Director of Planning doubt exists as to the compatibility of either use or appearance. g. All public utilities, including all feeder lines from ewistIng utility facilities within the public right of way shall ' placed underground in accordance with City Ordinance h. All outdoor lighting shall be of an ornamental nature and shall be so shaded and a&usted that the light there- from is directed to fall only on the same premises upon which light source is located. Off-street parking shall be provided on the basis of three spaces (9 for each 1,dCd square feet or more of floor area, out shall not be less than 233 spaces. All areas udlized for automobile parking or for the circulation of automobiles shall be surfaced with no less than two inches of asphalt concrete or its equivalert. k. A landscaped planter encompassed within a siz inch ("Dike Mix") berm shall be installed with the void area at the end of each parking row. To adequately control the circulation of motor vehicles on -site, directional markings shall be installed. m. Installation of thirty-five foot driveways shall be pursuant to the approval of oversize driveways by the City Council. Provisions shall be made with the City of Nat- ional City for the installation of fire alarm boxes and wiring for same in accordance with the Fire Alarm System of the City of National City. o. Proper slope protection shall be provided on all ecavation and fills. If slopes are required these areas shall be planted to prevent erosion. p. Within the boundaries of the area encompassed by the issuance of planned development permit No. 26, Drive -In Restaurants and Restaurants providing primarily food to shall be prohibited. q • Seperate, detached accessory buildings to be utilized for pick-up and/or delivery services shall be prohibited. r. Ali fizecures to be installed on the roof or outside the proposed structures (i.e. refrigeration, air condi- tioning or heating facilities, et cetera) shall be screened from view. s. Trees, approved as to number and type by the Director of Parks and Recreation, shall be installed along frontage on both Euclid Avenue and Plaza Boulevard. C. Landscape approved by the Director of Parks and Recreation, shall, be installed within each planter area as provided in condition number iS of Planned Development Permit No. 26. u. A solid masonry wall no less than six feet in height shall be installed along both the easterly and northerly boundaries to appropriately screen the proposed development from ad.,oining residential uses. Said wall to be erected no closer than twenty feet from the property lines on Plaza Boule- vard and Euclid Avenue. v. All areas of landscape shall be provided with an adequate watering system and all such areas shall be permanently maintained tn a growing and healthy condition. Permitting any portion of the landscape to die or become deteriorated and not replaced shall constitute prima facie evidence of a violation of Planned Development Permit No. 26. w. Maintenance of all walls and fences shall be pursuant to the provisions of the Zoning Ordinance No. 962, as amended, of the City of National City. x. The use of an on -site free standing advertising structure shall be subject to City Council approval upon recom- mendation of the Planning Commission. y. Planned Development Permit No. 26 is issued for the direct benefit of the property owners land and the conditions therein shall run with such property and shall be binding upon the assigns and successors of said owner. In the event that• the City Council at any time finds and determines that any of the conditions as set forth have not been and are not satisfied, the property owner shall immediately correct said condition upon demand in writing from the Director of Planning. If said condition is not corrected within thirty days after written notice, the City of National City may cause such work to be done and the costs thereof shall be a lien upon said property. z. Drainage along the northerly and easterly property lines shall be provided by underground pipe, provided with adequate inlets, approved and installed to the specifi- cations set forth by the City Engineer of the City of National City. 3. In the event that the City Council should at any time find and determine that the above conditions as set forth have not been satisfied, it may declare this Permit void and of no further effect.
