HomeMy WebLinkAboutCC RESO 10,173RESOLUTION NO. 10,173 RESOLUTION AUTHORIZING EXECUTION OF A JOINT POWERS AGREEMENT WITH THE REDEVELOPMENT AGENCY OF THE CITY OF NATIONAL CITY BE IT RESOLVED by the City Council of the City of National City that the City Manager of National City is hereby authorized and directed to execute an agreement with the Redevelopment Agency of the City of National City for financing public improvements related to the E. J. Christman Business & Industrial Park I, California R-127 located with- in the City of National City. PASSED AND ADOPTED this 15th day of September, 1970. ATTEST: CITY JOINT POWERS AGREEMENT For financing public improvements related to the E. J. Christman Business & Industrial Park I, California R-127 located within the City of National City. This agreement is made and entered into between the City of National City, hereinafter referred to as the City, and the Redevelopment Agency of the City of National City, hereinafter referred to as the Agency. WHEREAS, the City has agreed to participate financially in the E. J. Christman Business & Industrial Park I redevelopment project being undertaken by the Agency, and WHEREAS, the cost of installing certain improvements will be shared jointly by the City and the Agency. NOW, THEREFORE, it is agreed between the parties: 1. The private consulting Engineer employed by the Agency to design public improvements for the redevelopment project will act as the City's consulting Engineer -for those public improvements which are of benefit to the project. 2. Contracts for the construction of the contemplated improve- ments will be -let through competitive bid, pursuant to law; by the Agency. 3.. Prior to the date bids are invited on said contract or contracts, the Agency will make available to the City, two copies of the plans.and specifications on which bids are to be invited. All construction plans shall receive the approval of the City Engineer of the City of National City prior to advertising for bids. 4. When bids are to be invited on any contract (excluding Engineering) for construction of public improvement, the cost of which is to be shared by the City and the Agency, the Agency shall first obtain written indication from the City Manager of the City of National City that funds are or will be available for the City's share of estimated costs. 5. The Agency and the City will each pay the successful Contractor and the Engineer directly for its respective prorata share of the costs thereof. The proration of expenses will be based upon the percentage of benefit of each public improvement to the E. J. Christman Business & Industrial Park I as stipulated in the latest approved Project Expenditures Budget and Financing Plan. The Agency shall prorate the respective prorata share of expenses between the City and the Agency and provide the City with both a copy of the statement and an analysis of the proration. The Agency shall be responsible for the delivery of both City and Agency warrants to the Contractors and Engineer. The Agency will be responsible for determining the appropriate timing of payments to Contractors and the Engineer. 6. Any and all property improvements made pursuant to the contract or contracts let under the authority of this Joint Powers Agreement shall be the property of the public agency having lawful authority over, and public responsibility for each portion of the real property on which said improvements are located, all pursuant to the provisions of the official Redevelopment Plan for the E. J. Christman Business & Industrial Park I redevelopment project. 7. Contracts by and between the Redevelopment Agency and each of the following investor -owned utility companies, i.e. California - American Water Company, The Pacific Telephone and Telegraph Company, and the San Diego Gas and Electric Company providing for the removal of existing facilities and the installation of new services, may also provide for the same services and activities outside the boundaries of the project area which are of benefit to the project, and the City of National City will be obligated for its proportionate share of the cost of those activities and improvements outside the project area, and the aforementioned utility companies are advised that by the terms and objective of this Joint Powers Agreement the Agency may sign a contract on behalf of and the City will honor its obligations thereunder on a prorata basis. 8. This agreement will automatically terminate upon installation and completion of all public improvements related to the E. J. Christman Business & Industrial Park I redevelopment project, Project No. California R-127. Dated this 17th day of September , 1970.
