RESOLUTION GRANTING ZONE VARIANCE PURSUANT -TO ORDINANCE NO. 962
(Z-74, Reduction in Rear Yard Setback at
2334 Division Street)
The City Council of the City of National City does
hereby. find, determine, order and resolve as follows:
1. That practical difficulties, unnecessary hard-
ship, and a result inconsistent with the 'general purpose and
intent of Ordinance No. 962 would occur through strict appli-
cation of the provisions of said Ordinance to thatcertain
real property hereinafter described.
2. That a Petition requesting a. variance has been
filed pursuant to the provisions of Section 12_of said Ordin-
ance and said Petition complies with all the requirements of
said section.
3. That the National City Planning Commission did
hold a hearing on said Petition and did recommend to. .the Cit
Council that a variance be granted.
4. That the:granting of a variance with reference
to the property hereinafter described will not defeat, but
rather willcarry out the general intent and purpose of the
National City Zoning Ordinance, will provide for the public
safety and welfare and will administer substantial .justice.
5. That a variance from the provisions of said
Ordinance No. 962 be and is hereby granted with reference to
all thecertain real property situated in the City of National
City, California, more particularly described as follows:
Lot 198 Map No. 437'Unit No. 2 National
Award Homes.
6. That the variance hereby granted is as follows:
Reduction in rear yard setback from 25 feet to 6 feet, to
permit the construction of a family room addition and exten-
sion ofthe kitchen to provide additional living area for the
family, subject to the following, conditions:
a. Within a period of time. not to exceed
sixty days from date` of City Council approval of resolution
granting zone. variance 2-74 theapplicant shall obtain a
building permit.
b All: construction shall bein accordance
with the plans reviewed by. .the Planning Commission and
placed on file in the Planning Department.
c. All construction shall be. .cornple:te. within
a period of time not to. exceed twelve months; from date of
issuance of a building permit_.
d. A certificateof occupancy shall be obtained
from the Department of Building and Housing within a period of
time not. to exceed twelve. months:from date of issuance of a
building permit.
7. In the event .that .the City Council should here-
after' find :and determine that the conditions above .set forth
havenot been satisfied, it may declare this .variance void and
of no further effect.
