HomeMy WebLinkAboutCC RESO 10,189RE90=i0E NO. 10 189 RESOLUTION GRANTING ZONT VARIANCE PURSUANT TO ORDINANCE NO. 962 (7-75, Reduction in Rear Yard Setback at 123 Ranger Road) The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That practical difficulties, unncessary hard- ship, and a result inconsistentwith the general purpose and intent of Ordinance No. rJ:)62 would occur through strict appli- cation of the provisions of said Orninance to that certain real property hereinafter describe. 2. That a Petition requesting a variance has been filed pursuant to the provisions of Section 12 said Ordin- ance and said Petition complies with all the requirements of said section. 3. That the National City Planning Commission did hold a hearing on said Petition and did recommend to the City Council that a variance be granted. That the granting of a variance with reference to the property hereinafter described will not defeat, but rather will carry out the general intent and purpose of the National City Zoning Ordinance, will provide for the public safety and welfare and will administer substantial justice. 5. That a variance from the provisions of said Ordinance No. 962 be and is hereby granted with reference to all the certain real property situated in the City of National City, California, more particularly described as follows: Lot 146 of O. D. Arnold Estates, Unit No. 4 6. That the variance hereby granted is as follows: Reduction in rear yard setback from 20 feet to 17 feet, to permit the construction of a family room addition, subject to the following conditions: a. Within a period of time not to exceed sixty days from date of City Council approval of resolution granting Zone Variance Z-75, the permit. lie nt shall obtain a building b. All construction shall be in accordance with the plans reviewed by the Planning Commission and placed on file in the Planning Department. c. All construction shall be complete within a period of time not exceed twelve months from date of issuance of a buildin permit. c. A certificate of occupancy shall be obtained from the Department of Build ng and housing within a period of time not to exceed twelve months from date of issuance of a building permit. 7. In the event that the City Council should here- after find and determine that the conditions above set forth have not been satisfied, it may declare this variance voi and of no further effect.
