HomeMy WebLinkAboutCC RESO 10,200RESOLUTION NO. 10,200 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT FOR MAINTENANCE OF TRAFFIC .SIGNAL MAINTENANCE WITH THE COUNTY OF SAN DIEGO BE IT RESOLVED by the City Council of the City of National City that the City Manager of National City is hereby authorized and directed to execute an agreement with the County of San Diegofor the maintenance of a traffic signal system at the intersection of Paradise Valley Road with Eighth Street and Plaza Boulevard. ATTEST: CITY CLERK AGREEMENT FOR MAINTENANCE OF A TRAFFIC SIGNAL SYSTEM AT THE INTERSECTION OF PARADISE VALLEY ROAD WITH EIGHTH STREET AND PLAZA BOULEVARD This AGREEMENT executed this day of , 1970, by and between the CITY OF NATIONAL CITY, a municipal corporation, hereinafter called the City, and the COUNTY OF SAN DIEGO, a political subdivision of the State of California, hereinafter called the County. WITNESSETH: WHEREAS, the intersection of Paradise Valley Road, Eighth Street, and Plaza Boulevard, located in the vicinity of National City, lies partly within the County and partly within the City, and WHEREAS, the City and the County have entered into an agreement dated June 16, 1969, Contract Number 4625-5050E for the design and construction of a traffic - signal system at this intersection, and WHEREAS, the City and County desire to enter into a joint powers agreement for the maintenance of a traffic signal system at this intersection. NOW THEREFORE IT IS MUTUALLY AGREED by and between the City and County as follows: 1. County hereby agrees to maintain, operate and repair the entire installation including the traffic signals, lighting system and advance warning system, and to pay the cost of power therefore, subject to reimbursement by City as specified in Paragraphs 2, 3, 4, and 5 of this Agreement. 2. County will furnish and perform all routine maintenance and inspection services necessary to keep the facilities specified in Paragraph 1 of this Agreement in satisfactory working condition. Such services shall include the following: patrolling, emergency service, relamping, painting of standards and heads, necessary minor repairs and adjustments, and replacement for routine maintenance purposes of controller equipment, detectors, poles, heads and lamps. County shall supply all necessary spare equipment; provided, however, that installation of additional equipment or facilities shall not be considered routine maintenance under the provisions of this paragraph. A flat monthly rate of two dollars and forty cents ($2.40) per signal head shall be paid to County by City for said routine main- tenance and inspection. County may adjust said monthly maintenance charge annually at the beginning of each fiscal year; provided, however, that if County elects to adjust said charges it shall give City thirty (30) days written notice in advance of the effective date of such adjustment. 3. County shall perform all extraordinary maintenance service, including replacement and/or addition of major equipment required because of obsolescense, wear or inadequacy, and repair of extensive damage due to vandalism, collisions, or any other cause. City shall reimburse County for two-thirds (66.6%) of the costs of labor, parts and equipment used and/or actually expended in performing said extraordinary maintenance. 4. Electrical energy costs for said traffic signal system shall be paid by the County; provided, however thatthe City shall reimburse County for two-thirds (66%) of the cost of such electrical energy. 5. County shall charge and City shall pay to County an additional amount equal to six percent (6%) of the total sum to be paid to County pursuant to Paragraphs 2, 3, and 4 of this Agreement. 6. County shall bill City quarterly for the costs and charges for the pre- ceding quarter due to County pursuant to Paragraphs 2, 3, 4, and 5 of this Agreement. Bills for extraordinary maintenance, including both replacement and repair, shall show an itemization of the costs of labor, parts and equipment used and/or expended in each particular instance. Payment 'shall be made by City to the County Engineer Department within thirty (30) days after receipt of said bills. 7. This Agreement becomes effective upon acceptance of the construction of the signal system specified in the Agreement dated June 16, 1969, Contract Number 4625-5050E and may be terminated at any time after the completion of construction of the traffic signal system by either party upon giving thirty (30) days prior written notice of intention to terminate.
