HomeMy WebLinkAboutCC RESO 10,218RESOLUTION NO. 10,218 A RESOLUTION REPEALING RESOLUTION NO. 5797 AND CREATING A NATIONAL CITY TRAFFIC SAFETY COMMITTEE AND PROVIDING FOR THE CONDUCT OF BUSINESS THEREOF, THE APPOINTMENT OF MEMBERS, AND THE FILLING OF VACANCIES. BE IT RESOLVED by the City Council of the City of National City that Resolution No. 5797 establishing a °`Traffic Safety Committee" is repealed. BE IT FURTHER RESOLVED that there is hereby. created. a National City Traffic Safety Committee which shall function under the following terms and conditions: SECTION 1. Name of Committee: The committee created hereby shall be known as the National City Traffic Safety Committee. SECTION 2. Membership and Terms: There shall be five members of the National City Traffic Safety Committee, ap- pointed by the Mayor of National City with the concurrence of the National City Council. A member's term of office shall be. two calendar years, commencing on the first day of January of any year, and ending on the last day of December of thenext suc- ceeding year. A person appointed to a vacancy on the 'National City Traffic Safety Committee shall serve -only the unexpired por- tion of any term during which 'such a member is appointed. SECTION 3. Election: of a Chairman: At the first meeting of the National City Traffic Safety Committee in any calendar year the members thereof shall elect one of their own as Chairman for the calendar year. The Chairman shall appoint a Vice Chairman. The Chairman of the Traffic Safety Committee shall preside at all meetings of the Traffic Safety Committee, and the Vice Chairman shall preside in the absence of the Chairman. Except :as herein provided the Chairman and Vice Chairman of the National City Traffic Safety Committee 'shall exercise no other powers except those vested in the members of the National City Traffic Safety Committee in general. SECTION 4. ?tiles` Governing the Conduct. of Business Insofar as possible, the National City Traffic Safety Committee shall conduct its business pursutant to the directions set forth in the "Guide to Legislative 'Procedure in California Cities", copies of which shall be distributed to the members of the committee. SECTION 5. Unexcused -Absences Create Vacancy in Office A member of the National City Traffic Safety Committee may not be absent from a regular or special meeting without the permission of the committee. Absences from regular and special meetings shall be excused by a vote of the committee for good cause shown. Trivial causes or matters of personal convenience shall not constitute grounds for the excuse of absences. The fact that a member hasp missed two consecutive regular or special meetings of the National City Traffic Safety Committee, without excuse, shall be reported by the Chairman to the Mayor and City Council. Upon the making of a report to the Mayor and City Council of the unexcused absence of a member of the National City Traffic Safety Committee for two consecutive regular or special emetings, the absent members office in the National City Traffic Safety Committee shall be vacant, without further action of the Mayor and City Council. shall thereupon be filled as provided SECTION 6. • Chief, of Police Such a vacant office in Section 2 herein. to: be Advisory Member and Secretary to Committee: The Chief of Police of National City shall be a non -voting, advisory member of the National City Traffic Safety Committee. In addition, the Chief of Police, or his delegate, shall act as Secretary to the Com- mittee. The proceedings of the National City Traffic Safety Committee 'shall be recorded in a minute book to be prepared and kept by the Chief of Police of National City. The minute book shall be kept in the office shall be .available to inspection during normal working hours. of the Chief of Police, and by any interested person Following each meeting of the National City.Traf- fic Safety Committee the Secretary shall forward to the National City Council an abstract of the meetings thereof, reflecting any affirmative action taken or recommendations made by the Committee. SECTION 7. City Engineer to be :Advisory McMber. The City Engineer of National City, or his delegate, shall be a non -voting, advisory member of the National City Traffic Safety Committee. All requests for technical advice to the National City Traffic Safety Committee shall be handled by the City Engineer. SECTION 8. Scope of Functions" of Committee: The National City Traffic Safety Committee shall study and report on all matters referred to it by appropriate public agencies - or private citizens concerning traffic safety in National City. The Traffic Safety Committee shall conduct such investigations and make such reports as it is directed so to do by the National City Council. The National City Traffic Safety Committee may also make such investigations and reports, upon the 'request of responsible private citizens or private organizations as it deems appropriate. If a question arises as to the propriety of any particular investigation or report by the National City Traffic Safety Committee, the question shall be -referred to the City Council for instructions. In conducting investigations and making reports con- cerning matters properly before it, the National City Traffic Safety Committee shall concern itself only with matters re- lating to the safe and orderly flow of vehicular and pedestrian traffic within National City. The National City Traffic Safety Committee shall not concern itself witheconomic and business factors which may relate to issues of traffic safety. SECTION 9. Meetings: The National City Traffic Safety Committee shall meet at .least once a month, on a day of the month, and hour of the day, to be designated by resolu- tion adopted by the 'Committee on its first meeting of any calendar year. All meetings of the National City Traffic Safety Committee shall be held in conformance with applicable statutes concerning open and public meetings. All meetings of the National City Traffic Safety Committee shall be held in the City Council Chambers, 1243 National Avenue, National City, California. Field trips of the Committee may be held after appropriate notice, pursuant to applicable state laws. SECTION 10. Designation of incumbents as Members. At its first regular meeting following the adoption of this resolution, the members of the National City Traffic Safety Committee shall draw lots to determine the terms of office of the National City Traffic Safety Committee which is created by this resolution. At said meeting seven lots shall be drawn, one for each incumbent member. Two lots shall be marked with a zero, and the terms of office of the drawers thereof shall expire on December 31, 1970. Two more lots shall be marked six months and drawers thereof shall become members of the National City Traffic Safety Committee, created by this resolution, with a term of office which will expire on June 1, 1971. Two more lots shall be marked nine months, and the drawers thereof shall become members of the National City Traf- fic Safety Committee, created by this resolution, with a term of office which will expire on September 1, 1971. One lot shall be marked one year, and the drawer thereof shall become a member of the National City Traffic Safety Committee, created by this resolution, with a term of office which will expire on December 31, 1971. The Chairman shall draw lots on behalf of any absent member. THEREAFTER, the Mayor shall appoint 3 members whose terms shall expire on December 31, 1972 and two members whose terms shall expire on_Deceniber 31, 1973.
