RESOLUTION ACCEPTING COVENANT RUNNING WITH
LAND AND DIRECTING THE RECORDING THEREOF
BE IT RESOLVED. by the City Council of the City of
National City that a Covenant granted to the City of National
City by Forrest W. and Josephine Hoffman, affecting property
at 2785 E. l6th Street is hereby accepted and the City Clerk
is directed to record the same.
PASSED AND ADOPTED this 25th day of November,
1969.

COVENANT RUNNING WITH THE LAND
THIS COVENANT is made by FORREST W. and JOSEPHINE
HOFFMAN, hereinafter referred to as "OWNERS".
WHEREAS, FORREST W. and JOSEPHINE HOFFMAN are the
owners of that certain real property located in the City of
National City, County of San Diego, State of California, des-
cribed as follows:
The Northerly 170 feet of the Southerly 200 feet
of the Easterly 66 feet of the Southwest corner of Quar-
ter Section 106 Rancho de la Nacion according to Map No.
166 filed in the office of the County Recorder. (2785
E. 16th Street)
WHEREAS, said owners desire to maintain on their
premises two dwelling structures, although the zoning laws
of the City of National City allow only one residence struct-
ure on the property above described, and
WHEREAS, said owners have represented to the City
of National City that the dwelling structure to the rear of
their property at 2785 E. 16th Street has been converted from
a dwelling place to a guest house, and
WHEREAS, the City of National City has threatened
to institute proceedings to raze said structure, and
WHEREAS, the City Council of the City of National
City has expressed it willingness to forego an abatement pro-
cedure if the owners will promise that the structure at the
rear of the premises at 2785 E. 16th Street will always be
used as an accessory building or guest house and never be used
as a premise dwelling structure or rental unit, and
WHEREAS, the owners .desire that the City will fore-
go its threatened action to abate a nuisance;
NOW, THEREFORE, in consideration for the City of
National City not taking action to raze a dwelling structure
on the above described real property, to the rear of said
premises, commonly known as 2785 E. 16th Street, National
City, California, and in consideration for the permission of
the City Council for the owners to maintain said structure
as a guest house and/or accessory building said owners
covenant for themselves and their heirs, successors, assigns,
executors and administrators as follows:
1. Said owners promise that the structure to the
rear of their premises, as above described, commonly known as
2785 E. 16th Street, National City, California, shall be main-
tained as a guest house and/or accessory structure.
2. Said owners agree that the above described
guest house and/or accessory structure will never be equipped
with kitchen facilities of any type or kind whatsoever.
3. Said owners promise that the above described
guest house and/or accessory structure will never be used as
a' rental unit.
4. Said owners promise that officers and employees
of the City of National City will be granted the right to in-
spect said premises at reasonable times, upon their request,
to ascertain compliance with this Covenant and with all laws.
This Covenant shall run with and be a burden within
the described property.
